“易容犯罪”引发的法律思考--以“人皮面具”为视角

近些年来，全国多地发生以“易容”的方式实施盗窃、抢劫、强奸、诈骗等犯罪行为的案件。目前，在中国对“人皮面具”并不是特许管理，而“人皮面具”被不法分子利用给社会带来的安全隐患正日益凸显。针对目前形势，可以借鉴“管制刀具”的管理模式加强对“人皮面具”的管理，从生产源头、销售渠道、使用管理和立法上加强管控，避免被不法分子利用。笔者从“人皮面具”的国际监管出发，借鉴管制刀具的管理经验，试图从法律的视角对“人皮面具”的管理找到出路。

为了研究nsp2的非必需区在动脉炎病毒复制中的作用,采用定点突变PCR(site direct PCR)法对PRRSV全长感染性克隆pAPRRS的nsp2进行了系列缺失。结果显示,通过病毒拯救发现,nsp2部分区段可以忍受一定程度的缺失,但大幅度的缺失影响了病毒的复制、RNA合成翻译甚至病毒颗粒的成熟过程。结果表明,nsp2中多个氨基酸的变化可能影响PRRSV中多聚蛋白的水解、加工、成熟或RTC的组装。     

法院调解中的法律信息补偿机制

在缺乏专业法律信息来源时,法院民事调解中的当事人往往存在法律信息不对称情形。信息劣势方缺乏对权利内容及其救济的全面认识,在调解中往往造成不利后果,而此种不利后果没有畅通机制给予修正,使调解结果并未彻底解决纠纷。因此,应确立法官对法律的释明权,鼓励法官提出公平合理的调解建议,以补偿信息劣势方的法律信息。
