骗用贷款罪的解构性思考

《刑法修正案(六)》生效后,我国在贷款类犯罪中增设了骗用贷款罪。该罪弥补了贷款类犯罪的漏洞,也显现出高利转贷罪的多余。骗用贷款罪和贷款诈骗罪可以很好地规范贷款行为。高利转贷罪、骗用贷款罪、贷款诈骗罪在获取银行或者其他金融机构贷款时都是使用的非法手段,那么合法取得贷款后,非法使用的,也应该根据行为人的客观行为进行定罪。     

论国际刑法的正义价值

从法的属性看,国际刑法本质上是一种国家之间的制度,国际刑法的正义价值观首先源自国内刑法的正义价值观。由于现行国际法体系中没有超国家机构的存在,且国际法与国内法的渊源不同,国际刑法与国内刑法有相互符合的正义要素,但这些要素在各自领域中又存在着明显的内涵差异。国内刑法正义价值赖以支撑的平等、公平和正当等要素,急需国际刑法以立法和司法的实践加以确认和吸纳,并同时承袭国际法固有的正义基石。从国际人权法的视角分析,国际刑法的正义价值在于尊重和保护人权。国际法体系内的人权法与国际刑法,因正义价值的关联而构成了既对立又统一、相伴相生的矛盾共同体。     

行政法视角的警察临战

本文从警察临战行政管理出发,借助对警察临战行政权的剖析,揭示了警察临战行政法规的渊源和构建线索,即临战前的行政立法、临战中的行政程序和临战后的行政救济。

Postmortem serum uric acid and creatinine levels in relation to the causes of death

Serum uric acid (UA) and creatinine (Cr) mainly derive from skeletal muscle tissues. Although, remarkable postmortem stability of the serum levels has been reported, there appears to be very poor knowledge of the diagnostic value in investigation of death, except for uremia. The aim of the present study was to evaluate postmortem serum UA and Cr levels using 395 forensic autopsy cases, in comparison with blood urea nitrogen (BUN), for investigation of the pathophysiology of death with special regard to the causes of death involving possible skeletal muscle damage, e.g. due to hypoxia, heat or agonal convulsions. Cr and BUN showed relatively good topographic stability in the cadaveric blood, whereas, UA was often much higher in the right heart blood than in the left heart and peripheral blood, independent of postmortem intervals. Moderate to marked elevation of Cr and BUN accompanied with hyperuricemia was observed in delayed death. In the acute death cases (survival time <30 min), UA, especially in the right heart blood, showed a considerable elevation in mechanical asphyxiation and drowning. The Cr level in fire victims with a lower carboxyhemoglobin (COHb) level (<60%) was significantly higher than in those with the possible fatal level (>60%). A similar elevation of Cr was observed in fatalities from heat stroke and methamphetamine (MA) poisoning. The observations suggested that hyperuricemia in acute death may be indicative of advanced hypoxia and that elevated Cr level may reflect the skeletal muscle damage, especially due to thermal influence.     

Histopathological findings of cardiac conduction system of 150 Finns

One hundred and fifty heart specimens were collected from the cases submitted for autopsy in the Department of Forensic Medicine in the University of Turku in March-May 1995 and May-July 1996, respectively. The cardiac conduction system (CCS) of these hearts were examined in order to find out the histopathological changes in the CCS of Finnish persons and their forensic pathological significance. There were 94 males and 56 females. Almost all age groups were included. The results revealed that in most of the persons the fibrous tissue and fatty tissue in the CCS increased with aging. In about half of the persons, there was deposition of calcium in the central fibrous body, pars membranacea, and the top of the musculature in the interventricular septum. In seven cases, the atrioventricular node (AVN), His bundle (HB) or bundle branches (RBB, LBB) were compressed by the calcium deposition. Hemorrhage, inflammation, amyloidosis, tumor, fatty infiltration and developmental malformations were observed in 31 cases. Twenty-eight cases died of myocardial infarct, among them, no involvement of the CCS could be observed. The authors concluded that routine examination of the CCS is helpful for revealing diseases of the CCS and improving the quality of forensic pathological diagnosis.     

邻避效应向环境群体性事件转化的机理研究——以四川什邡事件为例

随着经济社会的快速发展,各方面事业都取得显著成就,与此同时,公共危机事件也呈高发态势,给人民生命和财产带来巨大损失。政府在应对危机事件方面采取了一系列措施,建立了应急管理体系,健全了体制、机制和法制,取得了明显进展。但在公共危机事件风险防控理论研究方面存在很大空间。为此,可以从系统脆弱性理论视角分析公共危机事件生成的机理,探索公共危机事件产生的内在逻辑,为公共危机事件治理提供理论的借鉴。     

HS-SPME-GC/MS联用法测定生物检材中的百草枯

目的建立检测生物检材中百草枯的顶空固相微萃取-气相色谱-质谱联用（HS-SPME-GC/MS）的分析方法。方法尿样中加乙基百草枯作为内标,在氯化镍作催化剂的条件下,用硼氢化钠在碱性条件下进行还原,HS-SPME萃取,提取物经GC/MS分析。全血需先离心,沉淀血细胞提取上清液,再用甲醇沉淀蛋白。最终得到的上清液加内标乙基百草枯,以下操作同尿样。结果尿样和血样中的百草枯的还原产物在1.0μg/mL~100μg/mL范围内线性关系良好,回归方程分别为y=0.0957x-0.0163,r=0.9974（n=6）;y=0.1096x＋0.0871,r=0.9964（n=6）。尿样、血样低、中、高三个质量浓度,RSD值均小于7%。回收率分别为尿样85.49%~100.83%,血样94.72%~99.68%。结论本法操作简便易行、灵敏度高、快速准确。为检测生物检材中的百草枯提供了有效的方法。     

上海自由贸易试验区对我国涉外经济法制转型的影响

上海自贸区正式获准成立,这是中国法治转型中的重大创新。上海自贸区内通过临时性的授权调整,逐步推进行政审批体制改革,实行准入前国民待遇和"负面清单"管理模式,以此推进政府职能转变;在投资领域努力扩大服务业的投资开放、促进外商投资准入制的转轨、构筑对外投资服务促进法律体系;在贸易领域积极推动贸易结构的转型升级、提升国际航运服务能级;在金融领域应加快金融制度创新,增强金融服务能力,实现"在岸金融"与"离岸金融"的互动;并在争议解决机制构建方面也进行了卓有成效的探索。     

基于MRI的中国汉族成人颅面径线测量与分析

目的通过MRI和VGStudio MAX 2.2软件对中国汉族成人颅面相关径线进行测量,并分析其与性别、年龄、身高以及体重的关系。方法按颅面标志点设定4条径线。A径线：在正中矢状面上颏下点至头顶点的最大直线距离;B径线：在正中矢状面上发际点至后头点的最大直线距离;C径线：在水平面上左、右外眼点间的最大直线距离;D径线：在冠状面上左、右侧颧点间的最大直线距离;用VGStudio MAX 2.2软件对MRI图像数据进行三维重建,直接用软件的测量工具对颅面的相关径线进行测量,并用SPSS 16.0进行分析。结果 A、B、C、D径线的均值分别为（237.54±8.63）mm、（173.07±8.28）mm、（89.58±4.46）mm、（127.34±8.16）mm,与性别有着显著性差异（P〈0.01）;其中A、C、D径线与身高,A、D径线与体重,C径线与年龄,均存在明显的直线相关关系。结论中国汉族成人颅面径线A、B、C、D均存在明显的性别差异;且A、C、D径线与身高,A、D径线与体重,C径线与年龄,均存在明显的直线相关关系。
