缅甸蒲甘王朝《加苏瓦王公告碑》刑罚方式源流研究——两个来源：印度原始佛教与《摩奴法典》

《加苏瓦王公告碑》是缅甸蒲甘王朝后期一块重要的碑铭。该碑铭中有很大一部分篇幅是对偷盗者刑罚方式的规定和描述,通过与原始佛教经典和《摩奴法典》中相关部分的比较,既可以看到它对原始佛教经典中地狱刑罚方式的借鉴,也可以看到《摩奴法典》与《加苏瓦王公告碑》中刑罚规定具有一脉相承之处。     

STR HUMARA locus gene and genotype frequencies in Han and Bei populations in China.

For the purpose of the population genetics study of the HUMARA locus, the allele, and genotype frequencies were determined in two Chinese population samples (Han-101, Bei-113) using PCR, PAGE, and silver staining. Fourteen alleles were found. The size of amplified fragments were 258 bp-315 bp. The observed heterozygosities were 0.83 in the Han population and 0.73 in the Bei population respectively. The expected heterozygosities were 0.91 in the Han population and 0.97 in the Bei population respectively. Both populations meet Hardy-Weinberg expectation, Han population x2 = 17.7206, df = 11, p > 0.05; Bei population x2 = 7.4268, df = 10, p > 0.05. The discrimination power were 0.95 in females and 0.89 in males in the Han population, 0.94 in females and 0.88 in males in the Bei population. Thus, the allelic frequency data can be used in the personal identification and parentage testing in the forensic science practice. The PCR test established in this study is robust and reproducible.     

刑法第182条之立法变迁及评析

我国1997刑法第182条将操纵证券交易价格的行为规定为犯罪,1999年刑法修正案将操纵期货交易价格的行为纳入刑法第182条的规制范围,2006年刑法修正案再度对刑法第182条予以修正。至此,刑法第182条适应了社会生活发展变化之需,加大了对操纵证券、期货交易市场行为的处罚力度。但刑法第182条将操纵证券市场的行为与操纵期货市场的行为混合规定,不符合经济行政法规对证券、期货市场规制不同步的现状,应分款予以规定;本条采取叙明罪状的规定方式,不符合本罪作为行政犯的基本规定方式,应规定为空白罪状。“操纵证券、期货市场罪”不能准确限定本条规定之罪的外延,应取名“操纵证券、期货交易市场罪”。     

我国警察行政补偿问题探究

目前,我国警察行政补偿制度还存在诸多不完善之处。其中,最为突出的问题集中表现在:补偿原则不统一;补偿范围不明确;补偿程序缺失以及救济效果不佳。在社会生活中,由警察行政补偿引起的纠纷逐渐增多,由警察行政补偿导致的警民关系也日趋紧张,造成不良影响。因此,为了更好地完善我国的警察行政补偿制度,就需要对目前我国警察行政补偿问题作系统性研究和分析,为实现警察行政补偿规范化、合理化提供理论支撑。     

Sudden Unexpected Death due to Chiari Type I Malformation in a Road Accident Case

This case concerns a sudden death of a patient with Chiari I malformation. A 17‐year‐old female was seen unconscious then fell off a motorbike during the vehicle acceleration. The girl was confirmed dead on the way to hospital, being previously asymptomatic and with a clean medical record. Autopsy findings showed an extremely extra‐long cerebellar tonsillar herniation in the left side and unexplained multiple small cavities in cerebral hemispheres. Microscopic findings revealed loss and abnormal migration of the Purkinje cells, as well as capillary congestion in the herniated tonsil. The cause and mechanisms of this sudden death are considered as the cardiopulmonary dysfunction and arrest resulted from compression of the medulla and cervical cord, which was induced by both the positional insult and minor head trauma. In addition, this study stresses the importance of cervical cord examination in the case of unexpected sudden death following road accidents.     

China Goes to Africa: a strategic move?

Entering the twenty-first century, particularly under the reign of Hu Jintao, China began to pursue an increasingly pro-active diplomacy in Africa. Most analysis on China's offensive diplomacy in Africa focuses on Beijing's thirst for energy and raw materials, and for economic profits and benefits. That is why it is often called ‘energy diplomacy’ or ‘economic diplomacy’ as if China, just like Japan in the 1980s, became another ‘economic animal’. But if one looks at the history of the PRC's foreign policy, Beijing has seldom pursued its diplomacy from purely economic considerations. Is this time any different? This article exams China's diplomacy in Africa from a strategic and political perspective such as its geo-strategic calculations, political and security ties with African countries, peacekeeping and anti-piracy efforts in the region, support for African regionalism, etc. It argues that China's diplomatic expansion in Africa, while partially driven by its need for economic growth, cannot be fully understood without taking into consideration its strategic impulse accompanying its accelerating emergence as a global power. Africa is one of China's diplomatic ‘new frontiers’ as exemplified by new Chinese leader Xi Jinping's maiden foreign trip to Africa in 2013.     

论现阶段运行状态下警察权力的社会控制

警察作用的发挥必须通过警察权力的运行来实现。现阶段警察权力运行状态呈现出多样化的状态,即复杂的国际、国内治安形势下警察权力的强化和权力的不当行使衍生警察权力异化现象等。在此状态下考察权力运行特征及内在要求,必须对警察权力加以社会控制。从内容设置和程序设置控制的法律制度控制手段、组织控制手段和文化控制手段上,探讨警察权力超越不良运行状态、努力达成社会控制构想的实现。     

德清县青年就业创业分析

文章以湖州市德清县为例,通过问卷调查和实地走访的研究方法,立足于县域城市青年对待就业创业的主观态度、青年就业创业的基本情况和主要特点,剖析新型城镇化背景下,县域城市青年就业创业的基本需求,并结合县域城市开展青年就业创业工作的内外在优势及制约因素,提出县域城市应从营造氛围、加强联系、激励及引导等方面推动青年就业创业工作。     

金融危机下美国对华“双反”法律问题新析

2004年以前,其它WTO成员并没有针对中国产品提起反补贴调查,主要面对和处理的都是有关反倾销方面的问题。金融危机背景下,以美国为首的发达国家对中国的反倾销反补贴并查案件不断增加。本文以美国对华双反的现状及特征为背景,通过对铜版纸案的具体分析,就政府和企业应该如何应对双反调查提出具体的法律建议。     

当前高校形势与政策课程建设的新探索

形势与政策课是高校思想政治理论课的重要组成部分。当前个别院校仍存在着对这门课程不够重视、课程内容缺乏时效性、教学方式陈旧等方面的问题。针对这些问题探索其对策：提高相关学校各个方面对课程的重视程度;不断更新课程内容,与社会实践相结合;创新完善教学模式,增强课堂实效性;改进考试方法,健全考评机制等。
