老实说,2004年第一次到中国时,我有点不适应这个国家。塔楼的影子倾斜在熙熙攘攘的街道上,因为里面挤满了人,看上去好像角角落落都要爆出来了一样。而我的长途客车正在烟熏的街道上慢慢拖拉着自己的身躯,穿过一脸沮丧的司机们。我知道中国人口众多,但我还没准备好把那些统计数字变成现实。然后是噪声——我不是说那些机械引擎持续的轰鸣,而是指那些在餐厅里大声尖叫的情侣们。

本文是2000年5月17日David Vaver先生就任牛津大学教授时的演讲,后经修订而成。虽时过七载,Vaver教授在本文中提出的问题,依然对我们具有重要的意义。Vaver教授回顾了知识产权的历史,质疑了知识产权的扩张趋势,检讨了知识产权面临的智识危机,提出了解决这些问题的思路。笔者将其译成中文,以期能对目前我国知识产权制度的发展有所启示。
