试论沉默权制度的设立对刑讯逼供的遏制

虽然我国法律明确规定严禁刑讯逼供,但该现象至今在我国的刑事司法实践中仍然相当普遍。不管刑讯逼供在现实的司法背景下是以秘密刑讯还是以变相刑讯的形式存在,都已经极大的损害了我国的社会主义法治建设。沉默权是现代法治国家刑事司法制度的一项重要内容,是犯罪嫌疑人、被告人能否真正享有辩护权的基础所在。本文通过对刑讯逼供的危害及其屡禁不止现象的解析,进而提出在我国设立沉默权的必要性和可行性,期望能从根本上有效的遏制刑讯逼供。     

The Zhuang——Within the Na Cultural Circle

Professor Tadayo Watabe is a Japanese expert on the origin and development of rice culture. In his book The Rice Road, Professor Watabe argued that an arc-like area extending from South China to the Assam plain in India is likely to be thestarting point of ＂The Rice Road,＂ and the source of the world＇s rice civilizations. The area identified by Professor Watabe basically overlaps with a belt plotting the distribution of places having the word Na in their name. Wenshan, the home of more than one million Zhuang population in Yunnan Province also lies within this arc.     

The Second International Festival of Intangible Cultural Heritage：A FEAST OF INTANGIBLE CULTURAL HERITAGE,A FESTIVAL FOR CHENGDU,A PARTY FOR THE WORLD

The Second International Festival of Intangible Cultural Heritage was held in Chengdu, the capital of Sichuan Province, which is known as the ＂Land of Abundance＂ in China, from June 1 to June 13, 2009. Delegations from 40 countries and different cities, autonomous regions and provinces of China participated in the festival＇s various activities. This, together with the International Intangible Cultural Heritage Protection Forum attended by the ambassadors to the UNESCO of over 30 countries, the Grand Parade at the opening ceremony and the promotional drives at the festival, turned the event into a true public cultural pageant.     

Xishuangbanna and an Artist Vision

Xishuangbanna lies in the southwestern province of Yunnan, which has the largest variety of minor ethnic groups in China. For the artist Zhang Guangzhi, Xishuangbanna is a magically beautiful place that inspires him to paint. There are other artists producing work with Xishuangbanna subjects, but Zhang has created a unique style that is all his own.     

Rising Russian-Western Tensions in the Global Security Context

Tensions between Russia and the West have grown increasingly apparent in recent years. This can be demonstrated in Moscow＇s ideological confrontations with the West, the intensifying rivalry over military strategic force, the fierce geopolitical confrontation, and grave contentions over energy resources between the two. The author concludes that in short, rising Russia-US tensions can hardly be remedied. It is a matter of political significance that merits careful consideration by the international community.     

美国、法国与冷战的终结：趋同、近似和分歧

本文着重探讨美法关系与冷战的终结。现有的冷战史研究明显忽略了法国在冷战结束过程中所发挥的作用。通过回顾和考察冷战后期美国和法国对苏联东欧的政策、德国的统一进程以及冷战后初期围绕新的欧洲秩序美法之间出现的分歧和竞争,可以发现,虽然法国的实力和影响力都不足以和美国相提并论,但是美法两国的角色是互相补充和支持的,对于冷战终结法国同样发挥了重要的建设性作用。总而言之,研究冷战史不能只着眼于美国,也应关注其他国家。     

Manas Studies： a New International Discipline

In 1999, the publication of five works in the first series of＂China Epic Studies＂ marked a new phase in epic studies in China. The subject of one of those five books was Manas. 20世纪80年代,美国警察管理部门实行了“社区警务计划”后,全国犯罪率下降。特别是纽约警察局制定的9条极具代表性意义的措施：“零容忍”主动出击、犯罪分析进程、12条警察新策略、降低犯罪原则、车辆定点安全检查、扫除逃学、录像监控、加强信息的集中和犯罪嫌疑人背景确认等,使纽约城暴力犯罪率下降80%之多。“9.11”事件终结了社区警务作为美国执法机构警力部署的重中之重的安排,美国的社区警务走向边缘化。然而,毋庸否认的是,社区警务和解决问题的相关理念已经给其他国家的执法实践带来了新鲜活力。本文的后半部分介绍了在欧洲的瑞典、挪威和中东地区的以色列以及其他地区实施社区警务计划的情况,最终这些评价反映出的仍是美国趋势。
