地方政府行政审批制度改革的困境与对策——基于F市外经贸系统的实证考察

基于流程再造的研究视角,本文对F市外经贸系统中的行政审批事项、内部运营、跨部门与跨层级审批等状况进行了实证考察,指出当前地方政府行政审批制度改革中存在越减越肥与审批拖沓、简政放权中的统筹不足、重审批中的轻监管等问题。文章提出应从提升行政服务中心的窗口办理效能、搭建行政审批网络一体化平台、建立审改公众参与制度、建立审改绩效考评制度等四个方面来推进行政审批制度改革。

Continuing disability review failure to cooperate process. Final rules

We are amending our regulations to provide that we will suspend your disability benefits before we make a determination during a continuing disability review (CDR) under title II and title XVI of the Social Security Act (the Act) when you fail to comply with our request for necessary information. Should you remain non-compliant for a period of one year following your suspension, we will then terminate your disability benefits. Although our current title XVI regulations generally provide for the termination of payments after 12 months of suspension, we are amending our regulations by adding this policy to our title II regulations and by restating it in the title XVI CDR regulatory provisions.     

Food labeling: health claims; dietary noncariogenic carbohydrate sweeteners and dental caries. Final rule

The Food and Drug Administration (FDA) is announcing its decision to authorize the use of a health claim regarding the association between sucralose and the nonpromotion of dental caries. Based on its review of evidence described in the proposed rule and comments submitted on the proposed rule, the agency has concluded that sucralose does not promote dental caries. Therefore, the agency has decided to amend the regulation that authorizes a health claim regarding noncariogenic carbohydrate sweeteners to include sucralose.     

Medical devices; immunology and microbiology devices; classification of reagents for detection of specific novel influenza A viruses. Final rule

The Food and Drug Administration (FDA) is classifying Reagents for detection of specific novel influenza A viruses into class II (special controls). Special controls that will apply to the device are the guidance document entitled, "Class II Special Controls Guidance Document: Reagents for Detection of Specific Novel Influenza A Viruses" and limitations of distribution of these reagents. The agency is taking this action in response to a petition submitted under the Federal Food, Drug, and Cosmetic Act (the act) as amended by the Medical Device Amendments of 1976, the Safe Medical Devices Act of 1990, the Food and Drug Administration Modernization Act of 1997, and the Medical Device User Fee and Modernization Act of 2002. The agency is classifying the device into class II (special controls) in order to provide a reasonable assurance of safety and effectiveness of the device. Elsewhere in this issue of the Federal Register, FDA is publishing a notice of availability of a guidance document that is a special control for this device.     

Work activity of persons working as members of advisory committees established under the Federal Advisory Committee Act (FACA). Final rule

We are revising our disability regulations under titles II and XVI of the Social Security Act to establish a new, special rule that affects individuals who are receiving payments or providing services as members or consultants of a committee, board, commission, council or similar group established under the Federal Advisory Committee Act (FACA). Under this special rule, we will not count any earnings an individual is receiving from serving as a member or consultant of a FACA advisory committee when we determine if the individual is engaging in substantial gainful activity under titles II and XVI of the Social Security Act (the Act). In addition, we will not evaluate any of the services the individual is providing as a member or consultant of the FACA advisory committee when determining if the individual has engaged in substantial gainful activity under titles II and XVI of the Act. Based on our experience with FACA advisory committees and the frequency and level of activity required by these committees, we believe that performance of activity on these committees does not demonstrate the ability to perform substantial gainful activity. We believe this to be consistent with Congress's view, as it has recognized in creating the Ticket to Work advisory committee, for example, that current disability beneficiaries should be considered for membership. This also will encourage individuals with disabilities to serve on FACA advisory committees, thereby providing the benefit of their unique perspective on policies and programs to the Federal Government.     

服务型政府建设的浙江经验

与市场化进程和社会治理体系发育互动演进的政府改革是"浙江模式"的重要组成部分。浙江服务型政府建设包含三个层面的内容:转变施政理念,实现从"发展型政府"向"服务型政府"转变;推进制度建设,实现从政府职能"重新定位"向"全面履行"转变;创新政策工具,实现从公共服务的"单一供给模式"向"复合供给模式"转变。但浙江服务型政府建设仍然面临着深入推进的现实困境。当前我国的权力配置结构未发生重大调整,地方政府行为逻辑未发生实质性转变,是服务型政府建设推进艰难的重要原因。在法治的框架下,以调整政府层级间关系为突破口,建立"混合型行政管理体制",增强地方政府自主性,加强社会问责,确保政府职能全面履行,是服务型政府建设的重要路径。     

公共事务复合治理的载体、实践及其走势分析——以杭州运河综保工程为例

以跨部门的复合治理方式取代碎片化的单一治理方式已成为公共事务治道变革的主要趋向。社会复合主体作为杭州首创的公共事务新型治理载体,因其良好的治理绩效而受到国内学界的较大关注。本文基于复合治理理论诠释了社会复合主体的生成及其意义,对杭州运河综保工程的复合治理实践进行个案剖析,并在反思个案运行困境的基础上,对社会复合主体发展的主客观条件及其走势作了讨论和展望。
