Macroeconomic Implications of China Urban Housing Privatization, 1998–1999

This paper presents evidence on the context, magnitude, and probable macroeconomic impacts of the privatization of Chinese urban housing in the 1998–1999 period. Various sources suggest that approximately one half of urban housing stocks were sold by work units to their residents at prices likely between one-fifth and four-fifths of their fair value during the period in question. This transaction significantly increased the wealth of urban Chinese households and improved the cash flows of state-owned enterprises. The case demonstrates the reaction of Chinese economic policymaking to economic stresses, and the capacity of the Chinese state to manage the business cycle.     

THE MODERN CREATION OF CHINA’S ‘HISTORIC RIGHTS’ CLAIM IN THE SOUTH CHINA SEA

The overlapping territorial and maritime claims in the South China Sea threaten to spark conflict in East Asia. On several occasions in recent years, disputes over the right to extract oil and gas have caused clashes between Chinese and Southeast Asian vessels. The United Nations Convention on the Law of the Sea (UNCLOS) was agreed by almost all countries in 1982 to try to resolve such disagreements. However, the People's Republic of China is currently trying to claim rights that go beyond UNCLOS and infringe on the UNCLOS-based rights of the other claimants. It deploys two arguments in particular: that the archipelagos in the South China Sea collectively generate rights to maritime resources and that China enjoys ‘historic rights’ in the sea. Neither of these arguments is found within UNCLOS, however. This article explores the origin of these Chinese arguments and finds that the ‘historic rights’ claim can be traced to a single Taiwanese academic writing in the 1990s during a period of intense debate in Taiwan over its relationship with the PRC.     

Tool mark striations in pig skin produced by stabs from a serrated blade

Stab wounds produced by serrated blades are generally indistinguishable from stab wounds produced by non-serrated blades, except when visible tool mark striations are left on severed cartilage. Using a pig-skin experimental model, we explored the possibility that similar striations may be left in skin. Stabs into pig skin were made using a straight spine coarsely serrated blade (121), a drop point finely serrated blade (20), a clip point irregular coarsely serrated blade (20), a drop point coarsely serrated blade (15), and as controls 2 non-serrated blades (40). Tool mark striations could be seen on the skin wall of the stab canal in all stabs made using serrated blades but in none with non-serrated blades.The striation pattern, reflecting the class characteristics of the serrated blade, was the same as that described in cartilage but less well defined. Fixation of the specimen with Carnoy's solution best preserved visible striations, and fixation with formaldehyde after staining with 5% Neutral Red was also satisfactory. Casting with vinyl polysiloxane dental impression material greatly facilitated photo-documentation. Applying the technique to homicidal stabbings may help identify stab wounds produced with serrated blades.     

Kinshasa: An urban elite considers city,nation and state

The declining salience of the nation state has led to an interest in whether other socially constructed forms, such as the city, have replaced it as a source of accumulation, belief and identity. This article seeks to explore whether this is true in the case of the capital of one of Africa's least successful states, Kinshasa in the Democratic Republic of the Congo (DRC). A survey explored the views towards the city of Kinshasa on the past of a variety of middle-class professional people as potential leaders in different occupations resident in different quarters of the city with roots in different parts of the DRC. Despite their somewhat abject material condition and despite extensive contacts internationally, the old dream of the nation state remains relatively strong among them while feelings towards the city largely reflect its situation in that dream rather than any new kind of loyalty. Members this class have extensive national networks of professional contact that help define their identity. New kinds of urban identity with cultural or political meaning beyond this could not be discerned contrary to the perspective held out initially.     

The legal role of medical professionals in decisions to withhold or withdraw life-sustaining treatment: part 2 (Queensland)

This is the second article in a series of three that examines the legal role of medical professionals in decisions to withhold or withdraw life-sustaining treatment from adults who lack capacity. This article considers the position in Queensland, including the parens patriae jurisdiction of the Supreme Court. A review of the law in this State reveals that medical professionals play significant legal roles in these decisions. However, the law is problematic in a number of respects and this is likely to impede medical professionals' legal knowledge in this area. The article examines the level of training medical professionals receive on issues such as advance health directives and substitute decision-making, and the available empirical evidence as to the state of medical professionals' knowledge of the law at the end of life. It concludes that there are gaps in legal knowledge and that law reform is needed in Queensland.     

Intentional torts claims in medical cases

Civil liability legislation enacted in each Australian jurisdiction following the Ipp Report recommendations created a clear divide between "negligence" and "intentional" torts. The common law action for trespass to the person is to varying extents maintained in the approaches taken by the State and Territory legislatures. This article explores the potential application of intentional torts claims in a medical context in light of recent case law. It identifies advantages for plaintiffs who plead intentional tort claims, including onus of proof, causation, remoteness, the quantum of compensatory damages and the availability of aggravated and exemplary damages.     

Interest Group Politics in Macau after Handover

After the handover of sovereignty in 1999 and the exit of the Portuguese administration, pro-Beijing and pro-government interest groups formed by local Chinese dominated Macau's political landscape. The major interest groups may be classified into three clusters: business organizations, labour unions, and neighbourhood groups. This paper examines the significance of interest groups in the enclave's politics and argues that their political power was from extensive grassroots support they received as well as Beijing's united front policies, the government's co-optation strategy, and the quasi-democratic political system. These interest groups also replaced the governor and under-secretaries to become the core of the patron-client networks in the political arena. This paper contends that the changing socio-economic environment, along with the advent of foreign casino investors, will gradually turn social support away from the interest groups and undercut their political influence. Balancing their pro-government stance and their role as representatives of their constituencies will therefore become increasingly difficult.
