物权法中的权利冲突表现为物权和债权的冲突以及物权之间的冲突,解决前一冲突的规则通常是物权优先于债权,但根据法律的特别安排,租赁权等特定债权能优先于物权;解决后一冲突的规则通常是顺位,即根据物权设定先后次序来排列同一财物上负担的限制物权的实现顺序,此外,还有限制物权优先于所有权等根据物权特性以及当事人意思表示来决定物权地位的特殊规则。     

清代中俄恰克图边境早期官制考

雍正年间,中俄开恰克图为边境贸易口岸,并开始设官进行管理。随着中俄经济、政治联系的加强,与之相适应的边境管理体制也逐渐形成。两国管理体制在恰克图贸易早期的服务宗旨是不同的:俄方用来打击边境非法贸易,保障对华正常贸易,以充实国库;中方则更关注边境地区的稳定,利用自己的管理体制监督蒙古人越界逃入俄境。     

关于职工医疗保险制度改革的调查与思考

调查表明,职工拥护医疗保险制度改革,但对具体方案意见较大,主要是职工自负比例过大等几项原因.解决改革中出现的问题,最大限度地化解职工疾病风险,保障职工的医疗和保健水平,是医疗保险制度不断完善的目标.     

对我国农民增收问题的实证分析

本文结合1983—2002年的相关数据,对农民增收问题进行了实证分析。结果表明:教育的发展、农村固定资产投资的增加、农林牧渔总产值的增长是农民收入增长的主要动力,农村劳动力数量增长对农民收入增长影响较小。而第一产业产值比重的减小和农村劳动力中第二、三产业就业人员的增加,会对农民收入增加产生负作用。最后本文提出了一些相关的政策建议。     

HPLC-ELSD法测定黄芪注射液浓缩液微乳中黄芪甲苷含量

目的:建立黄芪注射液浓缩液微乳中黄芪甲苷的含量测定方法。方法:采用(HPLC-ELSD)。色谱柱:Zorbax C18柱(4.6 mm×250 mm,5μm);流动相:乙腈∶水(36∶70);检测波长:206nm;灵敏度为0.08 AUFS,流速:1.0 ml/min;柱温:25℃。ELSD参数:漂移管温度为55℃,空气气压280 kPa。结果:黄芪甲苷在0.004 145 6~0.040 456 0 mg/ml时有良好的线性关系(r=0.999 1),平均回收率为96.53%,RSD为0.76%。结论:HPLC-ELSD法具有准确、简便、灵敏度高、无干扰而且重现性好的优点,适合用于黄芪注射液微乳中黄芪甲苷含量的测定。     

治理现代化视域下的“智慧警务”建设研究

智慧警务是在大数据时代因应治理现代化目标要求而对警务机制进行探索的一种新理念、新模式。在当前的智慧警务理论研究和建设实践中存在着技术中心主义和指标主义倾向,一定程度上忽略了人文因素和各地的经济文化差异。智慧警务建设应积极防范法律风险,构建和完善法律体系;激励多元的智慧警务模式;同时以人权保障为价值原则,充分保障公民个人信息权利。     

Building Cooperation among Groups in Conflict: An Experiment on Intersectarian Cooperation in Lebanon

Societies divided along ethnic or religious lines suffer from persistent conflict and underprovision of public goods. Scholarly understanding of how to strengthen intergroup cooperation remains limited. In this study, we set out to test the effectiveness of two interventions on intergroup cooperation: cross‐group expert appeal and participation in a cross‐group discussion. The laboratory‐in‐the‐field experiment is set in Lebanon's capital, Beirut, and involves interactions between 180 Shia and 180 Sunni Muslim participants. We find that the expert appeal increases intersectarian cooperation in settings that do not entail reciprocal exchange. On average, cross‐sectarian discussions do not improve cooperation, but those discussions in which participants delve deeply into the conflict's causes and possible remedies are associated with greater cooperation. Neither intervention diminishes the effectiveness of sectarian clientelistic appeals. The policy implication of our study is that intergroup cooperation can be strengthened even in regions as bitterly divided as the Middle East.     

Courts Uphold Denials of Coverage Even in the Absence of Mold,Lead, and Asbestos Exclusions

Courts have upheld insurers’ disclaimers on mold, lead, and asbestos claims under comprehensive general liability (CGL) policies, evidencing the importance of maintaining affirmative cover in the emerging environmental insurance marketplace. Removing a CGL mold, lead, or asbestos exclusion is helpful, but insurers may assert a coverage defense and not pay a claim for reasons that have included: failure to meet the burden of proof, failure to trigger coverage, an absolute pollution exclusion, a preexisting condition exclusion, a defective design exclusion, a faulty workmanship exclusion, a business risk exclusion, a known loss or loss in progress, a custody and control exclusion, an owned property exclusion, and late notice. Accordingly, affirmative coverage grants contained in environmental insurance policies are necessary to protect against such losses and maximize recoveries.
