对民主党派机关排列顺序问题的思考与建议

<正>在中国共产党的领导下,我国多党合作事业不断取得新的发展,民主党派在各省、市委机关的序列中都有相应的公务编制。从现实情况看,其各民主党派在省、市委机关中的序列位置,基本是排在各群众团体组织之后,有的在工作中还把民主党派视为群众团体。这样有碍于民主党派的政党形象和作用发挥,应该适时调整民主党派在省、市委机关序列中的位置排序问题。针对这种情况,我认为民主党派机关应排在政协办公厅之后、各群众团体之前,其现     

违约方请求确认合同解除的审查思路

违约方不享有单方解除合同的权利,违约方的单方解除通知行为构成违约,不能引起合同解除的法律后果。虽然在符合特定情形时,违约方可以要求解除合同,但只能以起诉的方式请求法院判决解除。对于违约方提起的确认解除合同的请求,法院经审理认为合同未解除的,在违约方未变更诉讼请求的情况下应依法予以驳回。     

The Sway of Geopolitics,Economic Interdependence and Cultural Identity: why are some Asians more favorable toward China's rise than others?

This article identifies the explanatory sources of Asians' perceptions about China's rise. The authors try to decipher the relative importance of individual-level explanatory variables such as socio-economic satisfaction, cognitive schema, and ideology and political values vis-à-vis that of the country-level structural variables such as geopolitical tension, economic interdependence and cultural identity. The empirical findings suggest that the growing perception that China has the most influence in Asia is more related to individual-level demographic variables which are associated with greater interest in political affairs, despite the fact that there is also some evidence that contextual factors related to economic interdependence also matter. A favorable perception of China's influence, on the other hand, is more associated with a less negative orientation on geopolitical and cultural factors, which both involve long-term historical memory and political feelings. Economic interdependence might engender adversarial feelings against China if the level of interdependence is high enough to cause economic vulnerability.

<正> 合法辩护(legal defense)在英美刑法理论中是受到特别重视的一部分内容,因为它同司法实践有着十分密切的联系。合法辩护是英美刑法上的一个概念,内容有:未成年、错误、精神病、醉态、被迫行为、警察圈套、安乐死亡、紧急避难、正当防卫等。其中绝大多数在大陆法系刑法中也有,但是在刑法理论结构上有很大差别。大陆法系刑法理论把这些内容放在犯罪构成范畴之内,从反面来补充说明犯罪构成要件的内涵。而在英美刑法理论中则把这些内容放在犯罪构成范     

公民有序参与的影响因素分析

公民有序参与受各种因素的影响,其中,政治制度化、公民权利意识、社会自组织、政府作用是最为重要的四个因素。高程度的制度化意味着公民参与渠道的完善和成熟,是公民有序参与进行的规则基础。较强的权利意识是公民有序参与的心理基础。发达的社会自组织网络是公民有序参与的组织基础。公正灵活的政府主导是公民有序参与的能促性基础。

随着物品证券化的兴盛 ,尤其是知识产权的出现 ,质权的适用范围进一步扩大 ,权利质权应运而生。由于我国担保法和其他相关法律关于权利质权的规定存在不完善之处 ,因而通过与我国台湾民法典在权利质权的概念、权利质权的标的、权利质权的设定等方面的比较 ,以便对完善立法有借鉴作用。     

Can Social–Emotional Learning Reduce School Dropout in Developing Countries?

An alarming number of students drop out of junior high school in developing countries. In this study, we examine the impacts of providing a social–emotional learning (SEL) program on the dropout behavior and learning anxiety of students in the first two years of junior high. We do so by analyzing data from a randomized controlled trial involving 70 junior high schools and 7,495 students in rural China. After eight months, the SEL program reduces dropout by 1.6 percentage points and decreases learning anxiety by 2.3 percentage points. Effects are no longer statistically different from zero after 15 months, perhaps due to decreasing student interest in the program. However, we do find that the program reduces dropout among students at high risk of dropping out (older students and students with friends who have already dropped out), both after eight and 15 months of exposure to the SEL program.     

中印缅孟经济走廊建设的重点、难点及对策

2013年5月,中国国务院总理李克强访问印度期间倡议建设的中印缅孟经济走廊,已经成为我国面向西南开放的重要战略支点,对四国而言都具有重要的战略意义。从当前贸易、投资、旅游往来和通道建设情况看,中印缅孟经济走廊建设初具雏形,但仍然受到一些硬性制约。深入推进经济走廊建设,应着重基础设施、产业园区、旅游、能源、农产品、金融等方面的合作,本文也提出了对策建议。
