浙江检察研究与检察改革情况报告

一、检察研究的总体情况 近年来,浙江省检察机关紧紧围绕党和国家大局、检察工作主题,着眼于检察工作的创新发展,积极开展检察理论研究,迎难而上,锐意拼博,不懈进取,取得了明显成效.     

论帮助犯罪分子逃避处罚罪之应然主体

对帮助犯罪分子逃避处罚罪主体范围的理解和适用,见仁见智。以罪刑法定为指导对本罪主体进行法条解析：本罪之应然主体以“身份说”为主,兼采“职权说”,皆以负有查禁犯罪的职责为前提。查禁犯罪活动是从调查、发现犯罪人或犯罪事实开始,到立案侦查、审查起诉这一过程的活动。负有查禁犯罪活动职责的各级党委机关中的政法委工作人员,不能成为本罪之主体。     

论警察勤务的规范化管理

警察勤务的规范化建设是新生事物,涉及公安机关各警种的方方面面,既有传统观念的改变,又有内部运作和体制的调整。要革除警务工作中的积弊,从不规范到规范,从不明确到明确,从运行无序到规范操作,需要我们结合工作实际大胆探索、改革,寻求适合我国国情的有中国特色的警务规范化道路。     

以"三个代表"重要思想为指导繁荣云南哲学社会科学事业

在建立社会主义市场经济、建设有中国特色社会主义的过程中 ,必须以“三个代表”的重要思想为指导 ,充分重视哲学社会科学研究的重大意义。云南省哲学社会科学研究在全省的经济社会发展中发挥了重要作用。进入 2 1世纪 ,新时期对云南省哲学社会科学研究提出了更高的要求 ,坚持“与时俱进” ,推进理论创新 ,才能使哲学社会科学研究更好地为党和政府决策服务 ,为建设云南民族文化大省服务     

32例无心外原因猝死者传导系统病理学观察

在对32例无心外原因猝死者传导系统(CCS)组织学观察中,发现31例 CCS 有异常和病变,其中11例可致猝死。这些病变包括有急性炎症、出血、脂肪浸润和结内外神经病变,且与猝死有关。     

城乡一体化发展地区治安防控网络建设的实践与思考

城乡一体化发展地区开发建设力度大,可供犯罪空间扩展,刑事发案增速快;管辖地域广阔,警力配置不足,基础工作薄弱;人财物流量大、流速快,刑事案件防控点多面广线长;发展格局尚未完全定型,管理机制相对滞后。对此,一要突出重点,强化专防,布建科学合理的区域防控卡点网络;二要因地制宜,强化群防,构架运行有序高效的群防群治网络;三要加大投入,强化技防,建设科技型社会面治安防控网络;四要夯实基础,强化管控,构建严密的基础工作防控网络。同时,必须依靠党政重视,部门协力;必须立足职能,以打促防;必须落实责任,强化考核;必须与时俱进,不断完善;必须加强宣传,强化自防。

This rule partially implements the TRICARE "sub-acute and long-term care program reform" enacted by Congress in the National Defense Authorization Act for Fiscal Year 2002, specifically: Establishment of "an effective, efficient, and integrated sub-acute care benefits program," with skilled nursing facility (SNF) and home health care benefits modeled after those of the Medicare program; adoption of Medicare payment methods for skilled nursing facility, home health care, and certain other institutional health care providers; adoption of Medicare rules on balance billing of beneficiaries, prohibiting it by institutional providers and limiting it by non-institutional providers; and change in the statutory exclusion of coverage for custodial and domiciliary care.     

Reinstatement of entitlement to disability benefits. Final rules

We are publishing final rules regarding the Reinstatement of Entitlement (Expedited Reinstatement) provision in section 112 of the Ticket to Work and Work Incentives Improvement Act of 1999. This provision allows former Social Security disability and Supplemental Security Income (SSI) disability or blindness beneficiaries, whose entitlement or eligibility had been terminated due to their work activity, to have their entitlement or eligibility reinstated in a timely fashion if they become unable to do substantial gainful work. These rules provide beneficiaries an additional incentive to return to work.     

Federal employees health benefits program; revision of contract cost principles and procedures, and miscellaneous changes. Final rule

The U.S. Office of Personnel Management (OPM) is issuing a final regulation amending the Federal Employees Health Benefits (FEHB) Acquisition Regulation (FEHBAR). This regulation provides additional contract cost principles and procedures for FEHB Program experience-rated contracts and is intended to clarify our requirements and enhance our oversight of FEHB carriers.
