维和行动中军事命令执行的刑法保障

参与联合国维和行动是我军常态化的重要军事任务,从维和实践看,专注于保护我军军事命令执行的军事刑法已经难以适应维和行动的需要。军事刑法有必要根据我军职能任务的拓展创新发展相关理论,将我军参与联合国维和行动期间军事命令的执行秩序纳入保护范围,并将维和期间界定为战时,增设保护维和军事命令执行的相关罪名,以完善军事刑法的理论和规定,更好地满足我军参与联合国维和行动的实践需要。     

Application of Volume‐of‐Fluid Method to Analyze the Viscosity Effect on the Spine Formation of Bloodstains

In bloodstain pattern analysis, the blood droplet volume and surface impact velocity play an important role, and many related experimental studies have been carried out. If an appropriate computational fluid dynamics (CFD) model that could solve bloodstain patterns, especially spine formation bloodstain patterns, can be obtained, the blood droplet volume and impact speeds at various crime scenes can be predicted more accurately. For this purpose, Flow‐3D software using the volume‐of‐fluid method was applied to analyze the behavior of human blood droplets during an impact event, especially focusing on the viscous effect on splashing, which forms the spine which can be used to predict the impact velocity. To obtain a non‐Newtonian viscosity model of blood for a computational fluid dynamic analysis, the venous blood samples of 163 people were tested using a hemorheology instrument. Among the venous blood samples of 163 people, 37 samples for which all blood test results were in a normal range were selected for the non‐Newtonian viscosity modeling. From the CFD analysis, it could be concluded that a non‐Newtonian viscosity model is more appropriate than a constant viscosity model for predicting splashing that forms the spine. The gradient of the non‐Newtonian model at a high shear rate has more of an effect on spine formation than that at a low shear rate. The lowest viscosity with a high velocity at the outer front of the radiating flow plays an important role in forming the splashing pattern.     

论我国《信托法》适用于社会保障基金投资信托的障碍及其排除

社会保障基金投资信托在性质上并非公益信托而是营业信托,故我国<信托法>关于公益信托的特殊规定并不能够适用于它;其对委托人与受益人的缺失成为该法在对这种信托用上的障碍,只有在观念上将社会保障基金视为法人才能够排除这一障碍.要确保其能够对这种信托有效适用,需要通过当然解释使该法关于受托人忠诚义务的规定能够被适用以禁止受托人利用信托财产为第三人谋取利益,并需要通过借鉴美国的做法将该法关于受托人谨慎义务的规定中的谨慎义务在内容上具体化详细化;为该法确立的过失责任原则只能够对在导致其设立的信托合同中不存在关于排斥这一原则适用的条款的这种信托适用.

环境污染行为与环境破坏行为导致的损害都属于环境侵害,需要建立一个完善的系统加以法律规制,从预防、惩戒、修复三大环节入手,给生态环境提供有力的法治保障。预防体系着重环境风险的行政监管,为环境保护构筑第一道防线;惩戒体系强调刑罚与行政处罚在适用层面的可操作性,对环境侵害起到应有的震慑作用;修复体系则事关环境能否可持续发展,通过环境公益诉讼的渠道,让民事赔偿能在环境修复上产生良好效果。     

Japan's security policy in relation to normal statehood

The paper begins by establishing the context in which Japan's normal statehood will be based. The paper shows how difficult it is for Japan to attain the status of a normal state based on the country's political forces and the rising powers in the Asian region. The paper looks at the relationships between Japan and other nations like China and South Korea, which should be considered by Japan in order to attain normal statehood. These are countries that initially were under the control of Japan, especially in business and even militarily, but today they are assuming their own position in the world; an aspect that is considered a threat to Japan's smooth return to normalcy. The paper takes into consideration the models that Japan can adopt or adapt to attain the status of a normal state. The three models discussed are those of Britain, Germany, and France. The main aspect discussed under these models is autonomy; this is based on the fact that Japan can only attain the status of a normal state if it becomes autonomous.

Stability and Specificity of Counterfeit Protection System Code

In this study, the stability and specificity of a counterfeit protection system (CPS) code were determined. This research involved an analysis of a counterfeit protection system code unit over time using the pattern location measurement method. We collected 379 sample sheets from 196 printers or photocopiers, covering 14 original brands, including 129 models. There was an interval of at least two months between the collections of samples from each machine. Four types of characteristics were established: CPS pattern unit, distance of the CPS unit, position of dots, size and shape of the dot. Except for the partial changes in the Xerox brand, no other brand exhibited changes over time. This implies that the CPS characteristics are stable. Meanwhile, no correlation was noted between the combinations of the characteristic systems in the collected samples, which implied strong specificity.
