促进教育的公平是美国联邦政府教育政策的核心,为达到此目的,联邦政府通过提供各种助学金和贷学金等方式,为美国大学生接受高等教育提供支持和保障。在具体操作上,联邦政府通过优化整合一系列的资助,形成一个包含几种方案的资助包配发给学生供其选择,从而达到资助的合理、公正与公平。     

Grain Procurement,Tax Instrument and Peasant Burdens during China's Rural Transition

In this paper, we argue that China's grain procurement system as a major instrument in rural taxation survived the communes and lost its importance only gradually in recent years. However, as agricultural liberalization progressed, the traditional tax instruments of ‘tax deduction prior to grain procurement payment’ and implicit taxation through ‘price scissors’ gradually eroded. Under such a circumstance, local governments in agriculture-based regions resorted to informal fees collected directly from individual rural households while the more industrialized regions shifted to non-agricultural taxes that are less costly in terms of tax collection. Empirical evidence based on a large panel data set supports our hypotheses of rural taxation in China.     

理性、务实完善刑事辩护制度

刑事诉讼法再修改正在全力推进,完善刑事辩护制度势在必行。刑事诉讼法应明确规定控方的举证责任,并由此进而规定犯罪嫌疑人享有沉默权,确立犯罪嫌疑人、被告人与律师的会见一般不受限制、监控的原则,赋予犯罪嫌疑人、被告人及其辩护律师知悉控方证据的权利;重新界定辩护人的职责,取消辩护人应当承担举证责任的要求,并增加和强化程序辩护的内容,承认侦查阶段律师的辩护人身份和地位;强化刑事法律援助制度,以突破刑事辩护的现实瓶颈。     

Politiques publiques d'innovation régionale et compétitivité mondiale : une étude comparée Québec-Wallonie

Abstract: The objective of this article is to analyse public initiatives to stimulate regional innovation in Walloon region in Belgium and in the Province of Quebec. The empirical analysis relies on the competitive poles program in Walloon and on the ACCORD project (Action Concertée de Coopération Régionale de Développement) in Quebec. The comparison will allow discussing the implementation and regional embedding of these programs and will reveal the similarities and the differences between the structure, the organization and the deployment of these strategies in the various regions targeted.

在刚刚过去的一轮通货膨胀中,农村的CPI涨幅持续高于城市。这种现象的存在不仅给农民带来更重的负担,也会阻碍国民经济的全面协调可持续发展。究其原因,一是根据一价法则,农村市场价格有向城市市场价格加速收敛的需要;二是农村市场自身不完善;三是政府的财政投入政策和宏观调控政策对农村市场不利。面对这种局面,要从财政投入、完善和规范农村市场制度以及调整宏观调控政策等方面入手解决问题。     

诉讼时效适用基础再思考——兼论物权请求权之于诉讼时效的适用

诉讼时效制度适用的基础在于切断久远的权利义务关系对当事人财产能力和信用评价的不利影响,维护现时交易安全和社会整体秩序。依照该理论,物权的“妨害除去请求权”、“妨害防止请求权”,以及不动产和依法应为登记并已登记之动产之“返还请求权”不应适用诉讼时效制度,除此之外的物权请求权均得适用诉讼时效。
