从我国劳动合同的实践所引发的思考

在我国计划经济体制下曾一度灭绝的劳动合同制度,随着我国经济体制的改革,又重新得到复苏并蓬勃发展。在制定《劳动合同法》时,我们既要积极改革这项制度中与当前劳动关系不相适应的地方,又要坚持从实际出发的原则,以求真务实的态度,根据我国现有国情,对这一用人(工)制度逐步加以完善。     

传染性羊痒病抗性基因分型方法的建立

根据GenBank中登录的绵羊朊蛋白编码基因PRNP序列,设计并合成了可用于单核苷酸多态性(SNP)快速分析的3对引物和7条分别标记了FAM和VIC荧光染料的MGB探针,建立了一种利用荧光定量PCR扩增反应对羊痒病抗性基因进行筛选的方法。结果表明,设计的引物及探针具有特异性和高效扩增性,能够用于PRNP羊痒病抗性基因的快速分型。借助该方法可建立一整套完善的预警监测体系来预防该病的发生,也可用于羊痒病的常规实验室诊断。     

Privacy,National Security,and Internet Economy: An Explanation of China's Personal Information Protection Legislation

With the development of the internet and the increasing role played by information technology in the economy, personal information protection has become one of the most significant legal and public policy problems. Since 2013, China has accelerated its legislation efforts towards protecting personal information. The Cybersecurity Law of the People’s Republic of China took effect on June 1, 2017. Legal scholars focus on the nature of personal information, discuss the necessity of enacting specific laws on protecting personal information, and attempt to propose relevant draft laws regarding personal information protection. Personal information protection, however, is not only a legal issue but also a political one. We need to look at the decision-making process about legislation on personal information protection in China. Why has China sped up its legislation on personal information protection since 2013? Is privacy, civil rights, or legal interest the main reason behind the legislation? Only after placing personal information protection legislation in a broader context, can we have a better understanding of the underlying logic and dynamics of personal information protection in China, and can perceive the potential content and possible future of these legislation. This paper argues that Internet industry development, the social consequences of personal information infringement, and national security are the main drivers of China’s personal information protection legislation.

论刑法学中“条件关系”的引入

＂条件关系＂是对应着＂因果关系＂而提出来的。行为与某种损害结果构成＂条件关系＂需要具备主客观两个方面的条件：客观上行为人没有实际预见,主观上行为人没有掌控某种损害结果的意志自由。＂条件关系＂的构成条件反面地说明着＂因果关系＂的构成条件,故＂条件关系＂的引入是对传统刑法因果关系理论的一种深化。＂条件关系＂能够＂阻却＂结果犯或结果加重犯的成立,即＂阻却＂刑事责任的形成或升级,从而成为刑事责任的一种分析工具。     

论服务型政府体系的构成要素

近年来关于服务型政府的研究很多,但学者们大都是从服务型政府的基本问题、模式构建、实践总结等方面来研究的,而从服务型政府体系的研究甚少。服务型政府应该是政府各部分目标一致、相互协调、运转灵活、解决问题高效的体系,它涉及到服务型政府的价值体系确立、服务型政府的权责体系如何划分、服务型政府的职能结构体系合理配置、服务型政府的组织机构设置、服务型政府的运行机制有效形成、服务型政府的规章制度体系建立等构成要素。     

A Study on China's OFDI influencing Factors and the Dynamic Effect of Economic Growth: Based on Principal Component Analysis and VAR Model

This paper selects the influence factors and economic growth effect of OFDI as a starting point, using China’s OFDI and related data, building VAR model, with a principal component analysis, co-integration test, impulse response and Grainger test method to explore the impact factors and the economic growth effect of China’s OFDI. The results show that the basic economic factors, investment environment factors and operating cost factors are the main factors affecting the development of China’s OFDI. At the same time, China’s OFDI and economic growth maintain a positive equilibrium relationship in the long term. In the short term, the economic growth effect of China’s OFDI is still weak, requires further development to better serve the economic restructuring and economic growth.     

中国古典文学作品教学改革策略探微

古典文学作品在大学语文课程教学中存在着与市场经济环境格格不入、教学方式有待改进、学生的学习态度有待矫正三个问题,提出了寻找古典文学作品与现实的契合点、革新教学方式、端正学生学习态度等三种改革策略,以期在教学实践中增强古典文学作品的教学效果,提升大学生的人文素养。
