司法功能与司法公正、司法权威

为达到解决纠纷、稳定社会的司法目的 ,首先要依靠司法公正。而作为实体公正的司法公正与作为程序公正的公正司法都有其不可克服的局限性。正是这些局限性成为导致司法不信任的口实 ,从而影响人们对司法判决的信从。克服这一局限性的一个有效途径就是树立和强化司法权威。司法公正、司法公信力和司法权威三者之间相互作用、相辅相成。现阶段我国司法公信力与司法权威缺失的现状几乎到了可怕的境地。必须正确认识制度权威、法律权威与法院权威、法官权威之间的关系 ,实现司法公正、司法公信和司法权威之间的良性互动 ,以确保司法目的的实现。     

李白道家文化人格的哲学意义——兼论李白生命价值观的对立统一

人格本体与自然本体同一的宇宙本体论哲学是李白道家文化人格的思想基础。它对原始道家哲学本体论的超越在于 :使主体在和宇宙的同一性关系上占据了主导地位。李白道家文化人格的宇宙境界表明主体渴望摆脱庸常的生活模式 ,升华到一个新的人性水平。儒道生命价值观的矛盾表现在 :儒家以精神不朽来消解死亡带给现世人生的消极意义。而道家认为只要顺应自然的循环变化 ,就无所谓生死 ,更无须被死亡所困扰。驱动儒家以进取精神介入现实人生的是对生命悲凉无奈的体验 ,促使道家以超然姿态淡出功名利禄的却是他对死亡乐观平和的领悟。儒道矛盾的生命价值观在李白对艺术精神境界的追求中获得了对立的统一     

调解的比较优势与法院调解制度的改革

调解、仲裁与诉讼，是现代各国解决民事纠纷普遍采用的方式，每一种方式都有自己的鲜明特色和比较优势，正是比较优势的存在是纠纷当事人可以选择适合于自己的方式，与判决相比，调解具有自愿性，和解性，协商性，开放性，灵活性，保密性等八个方面的比较优势，我国现行调审合一的诉讼体制妨碍了法院调解发挥其比较优势，应当改革我国法院调解制度，实行诉讼内调审分离。     

《词话丛编·历代词话》校读

唐圭璋先生所纂《词话丛编》,为当代治词学者案头必备之要籍。然中华书局于 80年代出版此编时 ,唐先生年事已高 ,无力亲自校点 ,书局乃不得不另请其他学者代庖。由于校点难度较大 ,校点者功力有所未逮 ,故错误丛出 ,亟待纠订。此文专就该编第二册清王奕清等《历代词话》中较严重的句读及标点错误加以辨正     

城镇廉租房制度建设中的政府职能定位

我国廉租房制度出现问题的重要原因是由于政府对这一制度的认识不足,政府在制度建设过程中出现职能缺位。因此,要推进廉租房制度的建设,必须对政府的职能进行准确定位,明确其职责范围,有效发挥政府在建设这项制度过程中的作用。     

May 4th and June 4th compared: A sociological study of Chinese social movements

There has been much talk about a link between the May 4th and June 4th Movements, but there is rarely a systematic study of it. This paper compares and contrasts the two movements in terms of structural conduciveness, the achievability of goals, organizational effectiveness, and the independent nature of social movements. It demonstrates that these four variables work in concert to determine the success or failure of any such movement. The Hundred Flowers Movement is examined to substantiate this theoretical hypothesis. In the end, I discuss the legacies of these intellectual movements and offer a few comments on the future of the Chinese democracy movement. Historical and comparative methods are used in the analysis. It is hoped that an exploration of the genesis and direction of these movements will help us understand how Chinese social movements have effected and will continue to effect social change in China.     

建设和谐社会与构建刑事和解制度的思考

2006年5月9日至10日,北京市法学会和西南科技大学在四川绵阳市主办了“宽严相济的刑事政策与和谐社会构建”学术研讨会。中国社会科学院法学研究所、北京大学、中国政法大学、西南政法大学等研究单位和大学的专家学者,以及最高人民法院、北京市及四川省政法系统等法律实务部门的领导和同志共400余人参加了会议。会议紧紧围绕构建和谐社会这个党和国家的总目标,深入探讨了如何调整和完善我国刑事政策的问题。现将会上专家的发言及论文选登如下,以飨读者。     

行政赔偿诉讼标的再认识——对最高人民法院《关于审理行政赔偿案件若干问题的规定》第28条的再论证

在附带提起的行政赔偿诉讼中 ,事实上存在两个不同的诉讼标的 ,一是具体行政行为 ,① 一是民事法律关系 ,二者性质不同。因此 ,当事人在提起行政诉讼的同时一并提出行政赔偿请求的 ,应当分别立案 ,以保障审判公正。同时 ,应考虑赔偿之诉的特殊性 ,对其撤诉区别对待 ,原告在撤诉后再次起诉的 ,法院应予受理。     

解读《企业国有资产监督管理暂行条例》的若干思考

《企业国有资产监督管理暂行条例》的颁布实施 ,推动了我国国有资产监督管理体制改革的深化。但是 ,存在的问题颇多。新体制并没有完全解决传统国有资产监督管理体制中的顽疾 ,没有真正实现政资分离、政企分开 ,甚至还极有可能产生新的矛盾和冲突。建议根据《国有资产法》制定有关规章、制度 ,依法对国有资产监督管理机构进行执法监督 ;建立独立稽查特派员制 ;建立国务院领导下的国有资产法律监督会员会。     

Localization and quantification of histamine in injured skin as parameters for the timing of wounds.

Localization and estimation of the histamine (HA) content in skin wound edges in 86 Sprague-Dawley rats and three cases of human injuries were carried out by a microfluorimetric method specific for this amine which forms a complex with o-phthalaldehyde (OPT). Distribution and density of the mast cells in the same areas were observed at the same time by toluidine blue stain. In all skin specimens with antemortem wounds, both the epidermis and upper dermis exhibit extracellular yellowish fluorescence of the HA-OPT complex. The fluorescent zone spreads in the wound edges with the lapse of time in vital injuries. The HA content increases gradually up to 30 min and then the yellow histamine fluorescence in areas 0-200 microns from the wound edge decreases. None of these features can be observed in normal skin and postmortem-injured skin. Mast cell degranulation can be demonstrated in all antemortem-injured skin. No statistical relationship exists between the number of mast cells and the HA-OPT fluorescence in either ante- or postmortem-injured groups. This study indicates that skin HA microfluorimetry by the OPT method is of practical value for distinguishing ante- from the postmortem wounds and for timing antemortem wounds.
