试论邓小平对知识分子理论的新贡献

邓小平历来十分重视知识分子问题 ,尤其是“文革”后 ,多次就知识分子问题发表重要讲话和指示 ,从根本上解决了我党长期以来在知识分子理论政策方面未然解决的问题 ,为落实知识分子政策以及制定新时期知识分子政策提供了理论依据 ,对党的知识分子理论作出了新的贡献。本文主要从三个方面加以全面论述。

优势证据在行政诉讼中的构成及适用——以廖宗荣案为分析对象

《最高人民法院公报》2007年第1期刊载的“廖宗荣诉重庆市公安局交通管理局第二支队道路交通管理行政处罚决定案”运用的“优势证据”标准引起了学界的广泛关注。本文尝试以这一案例为分析样本，通过对判决主文的剖析，希冀从中提炼出“优势证据”的若干构成要件；并通过对相关案例的对比，以期发现优势证据在行政诉讼语境中的适用前提。分析显示，公报案例中的“优势证据”暗含了三个构成要件，分别为身份要件、真实要件、关系要件；而数个案例的对比分析揭示，公报案例中的“优势证据”只适用于一对一证据的情境。     

Further Evidence on the Anatomical Placement of the Human Eyeball for Facial Approximation and Craniofacial Superimposition*

Abstract: Recently a small sampled cadaver study (n = 4) suggested that the human eyeballs are placed closer to the orbital roof and lateral orbital wall as first reported in the anatomical literature many years previously. This contrasts with central positioning of the eyeball within the orbit as advocated by the facial approximation literature. Given the limits of such small samples, this study re-examined globe position in nine new cadavers to help clarify which relationship is accurate. The results essentially confirm prior empirical findings except that the mean lateral divergences from the orbit center were found to be larger—the eyeball was found to be “displaced” 1.4 mm superiorly and 2.4 mm laterally. Medians calculated across all 13 cadavers from this study and the above-mentioned recent report refine these measurements to 1.4 and 2.3 mm respectively. Globe projection values were identical to those observed for living individuals (c. 16 mm).     

Chinese Wall system in large finance and market institutions

Large modern professional finance and market institutions have inevitably been subject to conflicts of interest, and the Chinese Wall has been an innovation, if not always successful, which provides a convenient solution to those problems. The Chinese Wall is designed to get a balance between commercial reality and public confidence. Attitudes towards the Chinese Wall vary from country to country, depending on the level of such balance. Experience in the relevant industries, however, has cast doubt on the effectiveness of the Chinese Wall in protection of the interest of investors, which suggests the current Chinese Wall is far from ideal, and consequently there is still a long way to improve the design and enhancement of the Chinese Wall, calling for the development of a more supplementary and enforcement mechanism.     

社会资源公正配置是实现社会公正的基本条件及其政策选择

社会公正是指社会资源在全体社会成员中的合理配置和享用。当前社会不和谐的主要根源是社会资源在社会不同主体之间的不公正配置。社会资源公正配置是实现社会公正的必要条件，它有助于维护城乡、区域的平衡协调，促进社会阶层结构的开放合理，保证社会流动的顺畅有序。促进社会和谐的政策选择必须体现社会公平的价值追求，这就要求必须普及国民待遇，加强制度建设，建立和完善高效的社会整合机制。

商牙纠纷是明清商业纠纷的重要组成部分,其存在类型及解决模式在一定程度上反映了传统国家对于商业社会控制的重要特征.明清牙人对国家赋予的公法职能的行使和滥用是引发诸多商牙纠纷的重要原因.

试论我国侦查构造的完善

侦查构造对刑事诉讼目的的实现有重要意义 ,而我国的侦查构造存在控辨力量悬殊。控辨力量失衡 ,监督方式不完善等缺陷 ,要解决此问题 ,应完善刑事诉讼程序 ,调整刑事司法体制。     

小议知识产权的正当性

随着知识产权的负价值功能日益突显及其为公众所普通认识，知识产权危机出现迫使人们对知识产权权正当性问题进行反思。从知识产权的起源入手，基于哲学理论追溯其正当性。不难发现，知识产权需要权衡私权与公权并确立其人权价值基础，才能具有实质正当性。这就必须有一定的法律限制，即在个人利益、他人利益与社会利益之间进行一种利益的平衡。
