推进公安交通管理体制改革的思考

通过对某市公安交通执法的调研,创新性地提出了公安交通管理的三个基本矛盾和两大基本关系,从多角度解析了规范执法问题,为推进公安交通管理体制改革吹响了号角.     

非法鉴定意见排除规则研究

我国非法鉴定意见排除规则的定义是指在诉讼过程中,由于鉴定的前、中、后程序出现严重违法或瑕疵,使得鉴定意见非法或者不合法,经过法官审查或合法当事人提出,使相应鉴定意见的证据能力或者证明力失效的规则。非法鉴定意见排除规则由鉴定前、中、后三个程序规则构成,对诉讼理念、制度、程序与社会等各个层面均有重要的意义。     

Pedestrian accident analysis with a silicone dummy block

When a car is parked in an inclined plane in a parking lot, the car can roll down the slope and cause a pedestrian accident, even when the angle of inclination is small. A rolling car on a gentle slope seems to be easily halted by human power to prevent damage to the car or a possible accident. However, even if the car rolls down very slowly, it can cause severe injuries to a pedestrian, especially when the pedestrian cannot avoid the rolling car. In an accident case that happened in our province, a pedestrian was injured by a rolling car, which had been parked on a slope the night before. The accident occurred in the parking lot of an apartment complex. The parking lot seemed almost flat with the naked eye. We conducted a rolling test with the accident vehicle at the site. The car was made to roll down the slope by purely gravitational pull and was made to collide with the silicone block leaning against the retaining wall. Silicone has characteristics similar to those of a human body, especially with respect to stiffness. In the experiment, we measured the shock power quantitatively. The results showed that a rolling car could severely damage the chest of a pedestrian, even if it moved very slowly.     

县级财政科技投入结构及其动力研究——基于安徽省C县的实证调查

县域财政科技投入主要体现为财政局拨付、科技局统筹管理的分配模式,但农林等其他县直单位同样也存在科技投入。县本级科技支出居主导地位,其他资金主要来自于上级部门的科技专项。科技推广体系呈现以县级科技集群为轴心的向下辐射形态,与企业、各类生产合作社、个人发生复杂的供需互动,相应对各类需求主体也产生不同的效益。以科技考核竞争、“发展一晋升”竞争、建楼面子之争和邻区比对等构成的混合竞争系统,是影响县域财政科技投入的主要动力。     

法治视野下的网络反腐

网络反腐法治化建设的宪政意义在于它是电子民主时代公民参政权的重要展现。参政权作为宪法及法律规定的现代社会公民享有的基本权利,在于确认和保障公民参与国家管理及社会事务的管理,监督和抑制权力滥用及其腐败。电子民主时代,网络参政拓宽了公民民主参与的渠道,公民参政权的实现变得切实可行。网络反腐法治化有利于公民参政权的落实,进而有力地推进民主监督制度的发展。网络反腐法治化的基本理念包括公众参与、规范统一、网民保护、信息公开,而建立健全网络反腐的法律制度,保护并激励网络举报人是其法治化的路径选择。     

英国与美国制定的扩建监狱计划

<正> 载至1985年12月为止,英国的在押犯人人数再次剧增,已超过48,000人,监狱设施已远远不能满足拘押犯人的需要。在这种情况下,英国政府计划将修建16座新监狱,其中14座监狱预定在1991年投入使用。这些扩建监狱计划完成后,将提供大约11,700个犯人的住室。这样,在90年代初期即可结束英国监狱严重超员的状况。     

Neo-liberalization and Incorporation in Advanced Newly Industrialized Countries: A View from South Korea

Historically closely associated with interventionist growth strategies, the demise of corporatism was widely predicted as neo-liberalism became the dominant economic paradigm from the late 1970s. The experience of social dialogue and social pacts in continental Europe during the 1980s and 90s, however, suggests that corporatism may have found a new economic purpose in the era of neo-liberalism. Similarly, in the developing world, the intellectual aversion to government accommodation of 'special interest groups' that accompanied the early phase of economic liberalization has given way to a more sophisticated appreciation of the economic advantages of social compromise. Using the case of South Korea, a country that recently established a social pact in support of its economic liberalization drive, this paper seeks to extend our knowledge about the compatibility between neo-liberalism and incorporation. The results contribute to the wider debate about the possibilities of diverse patterns of government–business–labour relations under 'actually existing' neo-liberalism. As one of the most advanced and successful newly industrialized countries, South Korea shares structural–institutional affinities with both advanced and developing societies. Hence, it represents an intermediate case of relevance to both the mature European and 'third wave' democracies.     

养老保险制度改革的私有化发展趋势

20世纪80年代以来,拉美以及西方一些国家时养老保险制度进行了变革,其总趋势就是对养老保险制度进行私有化改革。在融资方式方面,实行个人帐户制度,逐步实现养老保险从现收现付制模式向基金积累制模式的转变;在管理方式方面,建立私营养老基金公司,实现养老基金从政府机构管理向私营公司管理的转变。但养老保险制度私有化改革也存在着对养老保险制度互济机制的背离、私有化的不确定性等问题。     

从道德自律到制度制约：保持共产党员先进性的历史审视

共产党员是实现共产党先进性的最重要载体,共产党员的先进性制约着共产党的先进性。因此,保持共产党员先进性就成为中国共产党人在革命与建设时期始终要解决的重大课题。中共在保持共产党员先进性方面基于不同的理论预设,完成了从道德自律向制度制约的转变,审视这一历史性转变对于进一步加强执政党的能力建设,建设社会主义和谐社会具有重要的意义。     

流媒体技术在校园网中的应用

流媒体是使用流式传输技术的连续时基媒体 ,主要有顺序流式传输和实时流式传输两种方式。随着网络的发展 ,流媒体将成为未来的主流技术。很多学校在校园网的建设中 ,都架设了流媒体服务器 ,以推动教学和科研活动。制作流媒体服务器的第一步是安装和使用RealServerBasic,第二步是使用RealProducer制作实时广播 ,第三步则是检测网络广播是否成功。
