流浪精神病人救助管理困境与对策分析

近年来流浪精神病人问题日益引起重视,同时暴露出诸多问题,如政策法律不完善、各职能部门职责不明确、救助经费不足、预防及出口无法落实等。针对救助管理存在的问题及管理措施提出相关看法如下:从国家层面,完善法律政策,将流浪精神病人的救助管理工作纳入法制化轨道;从社会层面,建立权责明晰的社会救助体系;从医院层面,加强救助管理能力建设,重视住院流浪精神病人管理工作;坚持源头治理和彻底治理,创新流浪精神病人救助管理新思路,重点解决好流浪精神病人的预防和出口问题。

商标侵权纠纷中市场开办者的责任认定

市场开办者法律责任的认定不仅关系到商标权的保护,更关系到商场等服务行业的发展。然而,商标侵权纠纷中市场开办者的责任如何认定我国法律尚未做出明确的规定,如何处理此类案件理论及实务界均存在争议。本文在收集我国法院已经做出的部分判决的基础上,通过评析既有判决在法律适用方面存在的问题,进而评介、借鉴美国等主要国家的相关法律制度和实践,提出我国商标侵权纠纷认定市场开办者法律责任的法律依据及具体的认定标准。     

三棱、莪术对血瘀证模型大鼠血液流变性影响的比较研究

目的：比较破血药三棱、莪术对血液流变性影响的异同.方法：随机将动物分成空白对照组、模型组、三棱组（S组）、莪术组（R组）.前两组灌胃白开水,S组、R组分别灌胃100 g/ml三棱、莪术水煎剂,连续10 d.模型组、S组、R组于第10天复制模型.于第11天处死取血测定.结果：与模型组比较,S组不同切变率下全血黏度ηa1、ηa5、ηa30、ηa200均降低,R组只有ηa5、ηa30、ηa200降低,ηa1无变化.S组、R组红细胞变形指数均明显提高,S组平均血小板容积（MPV）明显降低,差异有显著性.S组与R组比较,ηα1、ηa5、ηa30明显降低,MPV显著改变（P＜0.05）.结论：三棱、莪术均可影响血液流变学指标,三棱作用优于莪术.     

浅谈多媒体在数学教学中的应用

我国现行的用益物权制度存在问题较多,严重影响了其实践作用的发挥。在重构我国用益物权体系时,不仅应对实践中争议较大的问题作出合理的解释,也要对缺漏之处及新情况、新问题做出积极的反映,最终形成以地上权、农用权、地益权、用益权为基础的民事基本法中的用益物权与特别法相辅相成的现代用益物权体系。
