社会公共组织及其成员的权利救济分析

加入 WTO后 ,社会事务管理的结构性缺陷 ,已严重阻碍着我国政府体制改革的步伐。本文在对社会公共组织进行定位的基础上 ,指出培育社会公共组织是我国政治体制改革的必然趋势 ;同时 ,只有将社会公共组织在行使公共职能时与其成员之间的纠纷纳入行政诉讼中来 ,才能最终在国家、社会、个人之间建立起政治生态平衡。     

Analytical Characterization of Erythritol Tetranitrate,an Improvised Explosive

Erythritol tetranitrate (ETN), an ester of nitric acid and erythritol, is a solid crystalline explosive with high explosive performance. Although it has never been used in any industrial or military application, it has become one of the most prepared and misused improvise explosives. In this study, several analytical techniques were explored to facilitate analysis in forensic laboratories. FTIR and Raman spectrometry measurements expand existing data and bring more detailed assignment of bands through the parallel study of erythritol [¹⁵N₄] tetranitrate. In the case of powder diffraction, recently published data were verified, and ¹H, ¹³C, and ¹⁵N NMR spectra are discussed in detail. The technique of electrospray ionization tandem mass spectrometry was successfully used for the analysis of ETN. Described methods allow fast, versatile, and reliable detection or analysis of samples containing erythritol tetranitrate in forensic laboratories.     

环境侵权救济之民事诉讼原告资格探究

环境侵权结果须借助自然环境这一中间介质方能发生,而环境的公共性、使用的非排他性等特征决定了受损权利具有公益与私益的双重特征,这也使得提起民事诉讼救济的原告主体有私益性原告与公益性原告的区分,其诉讼请求、诉讼标的、诉讼事由、诉讼利益归属等各有不同,而上述两类原告所提之诉同属民事救济的两种渠道、两个诉讼,可以合并或单独审理。     

台湾选民的政党认同——基于2004、2008、2012年三次“总统”选举的分析

经过2004年到2012年三次“总统”选举,台湾选民的政党认同逐渐结构化。新党、亲民党的认同者迅速下滑,“台联党”亦然,国民党认同的比例上升,民进党认同的比例则保持稳定,“中间选民”的比例逐步下降。在国民党和民进党认同者中,持强烈认同的比例不断上升,较弱认同的比例不断下降。从蓝绿两大政党看,年龄和受教育程度已非影响政党认同的显著因素,国家（族群）认同以及统“独”立场始终是影响政党认同的最重要因素,阶级地位具有显著影响,但是其影响力远不及国家（族群）认同以及统“独”立场。     

How can perception help us to understand the dynamic between EU member states? The state of the art

The paper reviews literature on perception within the international relations and the European Union (EU) studies in order to find out whether and how this concept can help us shed some light on the mutual relations between the EU member states. It examines the utilisation of perception as an analytical tool within the international relations where it was predominantly included into the foreign policy analysis approaches (image and role theory). Moreover, it was used for examining the views of the EU by other actors at not only bilateral but also multilateral level. Most studies analysed the perception of Asian countries, however, other areas, including Africa, were studied. Perception was utilised also at the EU level, when it was used for scrutinising different EU policies (foreign and security policies, enlargement), examining preference formation and influence of member states or investigating elite and public support for the European integration. The results show that perception is a valuable concept that can help us to analyse mutual relations between the EU member states in the enlarged and changed EU in several ways.     

价值观多元化与先进文化建设

价值观是人们的"主心骨"。在生产实践活动中,由于价值主体的不同,地域分布的各异,以及社会发展的时间性,主体价值观多元化已然存在,甚至引发价值观冲突。多元价值观通过文化的多样性得以彰显。处于转型时期的我国,面临着多元价值观及其冲突的现实,加强先进文化建设和正确的价值观教育,构建社会主义核心价值体系,以引领多元化价值观,树立社会主义共同理想,增强社会主义意识形态的吸引力和凝聚力,乃是践行科学发展观的重要基础。     

关于“公平”归责原则的思考

<正> 近年来,我国民商法的理论研究发展很快,其中侵权行为法尤为突出。在侵权行为法当中,归责原则或归责标准是一个核心问题;所以,凡论侵权行为法,必然要涉及于此。目前,学界对此的观点主要有三种:过错责任的一元制原则;过错和无过错责任并存的二元制原则;过错、推定过错(或严格责任、无过错责任等)及公平责任的三元制原则。三家之言各持其据,长期莫衷一是。作为二元归责原则的主张者,笔者认为三元制归责原则中的公平原则是不能成立的;实质上,它是一种“公平负担”或“衡平责任”的错误表述。     

菲律宾私立高等教育对我国民办高校的启示

菲律宾是世界上私立高等教育发展最具活力的国家之一,其私立高等院校历史悠久、实力雄厚,占高等院校总数的70%以上。本文通过对菲律宾私立高等教育特色的介绍,并结合当前我国私立高等教育发展实情,从监管机制、专业特色、师资队伍、办学经费等几个方面为我国民办高校提供启示和借鉴。     

公物致害责任与建筑物危险责任比较研究

与物有关的侵权,根据损害结果与物的危险性之间的关系,可以分为物之侵权、物上行为侵权和单纯行为侵权三类。其中物之侵权根据公物和私物在公共使用性上的根本差异,可以区分为公物侵权和私物侵权,公物侵权构成公物致害责任,而私物侵权中不动产侵权构成建筑物危险责任。公物致害责任与建筑物危险责任既存在相似性,又存在差异性,其差异性本质...     

Allelic and haplotypic frequencies at 11 Y-STR loci in Buryats from South-East Siberia

We have obtained Y-STR haplotypes in 12 loci (DYS19, DYS385, DYS389I, DYS389II, DYS390, DYS391, DYS392, DYS393, DYS437, DYS438 and DYS439) from 215 Buryat males. We have found that one haplotype (15-11,18-13-28-23-10-11-14-14-10-12) comprises more than 30% of Y chromosomes in this population while another haplotype (14-11,13-14-30-23-10-14-14-14-10-10) comprises additional 14% of chromosomes. The population under study seems to be very homogenous as far as Y chromosome is regarded and the most frequent haplotype seems to be the modal haplotype for Buryats.
