The orphan works dilemma and museums: an uncomfortable straitjacket

LEGAL CONTEXT: Orphan works are copyright works where the right holders cannotbe found. Without the consent of the right holder, a user facespotential liability for the unauthorized use of the work. Museumshave a duty to make cultural materials available to the public.However, the orphan works problem may pose obstacles to thenormal functioning of a museum. This article explores the problemof orphan works as it pertains to museums. KEY POINTS: Legislative solutions are being considered in addressing theproblem of orphan works in the United States. The museums, asa lobbying group, initially advocated for a safe-harbour rule.The U.S. Copyright Office recommended a limitation on remediesrule. Any legislative solution tackling the orphan works problemmust balance the benefits of using orphan works against theexclusive rights of creators. PRACTICAL SIGNIFICANCE: This article will inform readers of the orphan works problem.In addition, the lobbying efforts of the museums in trying toobtain desirable legislation are explored. By understandingthe various interests involved, readers can better anticipatethe possible orphan work solutions that the United States mayadopt.

国外证券投资对越南资本市场影响研究

国外证券投资(Foreign Portfolio Investment,简称FPI)是指外国资本为了获取资本利得、利息或股息收益,以东道国的证券资产为投资对象的活动。本文通过研究FPI在越南证券市场的发展情况,分析越南政府对FPI实施的管理措施及FPI对越南经济和资本市场发展所带来的影响,提出作为一个发展中国家,越南要在投资者准入、资金进出等方面加强对FPI管理的建议。     

论社区矫正立法与确立司法行政机关执法主体地位

2010年8月,十一届全国人大常委会第十六次会议初次审议的刑法修正案草案中,首次提出了“实行社区矫正”,这是我国社区矫正立法方面的一个重要进展。首先,在法律中出现“社区矫正”的字样,将逐步消除人们对“社区矫正工作法律依据不足”的认识;其次,通过社区矫正立法,对社区矫正执行部门进行科学合理的权力划分,将促进刑事司法权力的合理配置,进一步优化刑事法律制度。第三,通过国家立法途径,不断强化社区矫正工作经费保障、机构人员和制度建设,保障社区矫正工作顺利进行。     

国人头面部软组织厚度的MRI测量

用磁共振成像（MRI）方法对498例（男274，女224）中国汉族人头面部31个标志点（正中线16，侧面15）的软组织厚度分7个年龄组进行了测量。结果表明，国人（汉族）头面部软组织厚度一般随年龄增长而增厚，大约在45～59岁最厚，60岁以后又开始变薄；男女性头面部软组织厚度有性别差异，在大多数测量点男厚于女，在19个测量点中有显著性差异（0．01＜P＜0．05）。个体因素对颜面上下部软组织厚度有不同影响，下面部软组织厚度受个体因素影响较上面部大。

Learning geoeconomics: China’s experimental financial and monetary initiatives

China’s rise is increasingly impacting on the global financial and monetary order. To manage its growing centrality in global financial flows and its new relevance for patterns of currency usage, Beijing has been creating a set of new institutional arrangements in three crucial fields: the provision of crisis liquidity, development financing, and a global infrastructure to internationalize its currency. In contrast to the dominant power political interpretation of such developments, this article highlights the strong linkages of Beijing’s new initiatives with the changes in China’s capitalist development path and stresses their experimental character that serves to manage the economic and political risks of China’s accelerating financial internationalization. With a distinct learning attitude regarding its rising geoeconomic prominence and engagement, Beijing’s risk-averse strategy involves a very careful linking, layering, and nesting of new arrangements.
