公安机关在打击经济犯罪中面临的形势探析

由于我国社会主义市场经济体制尚未健全、法律体系还不尽完善 ,一些不法分子在经济领域中乘机进行犯罪活动 ,扰乱社会主义市场经济秩序。修订后的刑事诉讼法赋予了公安机关全面打击和防范经济犯罪的重要职责 ,经侦部门只有科学地预测面临的形势 ,抓住机遇 ,深化经侦工作改革 ,才能更好地服务于经济建设。

The Strategic Dialogue and Sino-U. S. Relations

On August 1-2, China and the United States held a strategic dialogue. This is in fact the first mechanized strategic dialogue between China and America. Both sides decided to hold such a dialogue alternatively in each other's capital twice a year.The significance of the first comprehensive and mechanized senior dialogue between the two sides to discuss strategic issues of common interest cannot be underestimated. Therefore, it was an event that attracted worldwide attention. Apart from paying attention tothe dialogue itself, the media hope to fully understand the cause of the dialogue, the result of the first strategic talk, the influence of the talk on bilateral relations. The Editorial Department of Contemporary International Relations invited scholars from the Institute of American studies of China Institutes of Contemporary International Relations to hold a discussion to provide our readers some food for thought over relevant issues.     

Islamic State Reflects the Darker Side of International Politics

In revolutions, it is crucial to identify who is the enemy and who is the friend. But when we look at Islamic State it is difficult to distinguish between the two. If there are only two participants, and the relationship is linear, there is no problem. But when there are multiple players, the problem becomes complex. When each player has many targets, and these targets overlap, conflict and vary, the friend-foe relationship becomes multi-dimensional and is often stereotyped. Not only is it complicated but also it can change widely over time and circumstances. A good example is the political game vis-a-vis ISIL. On the surface, most countries and factions regard ISIL as the enemy, but actually the true relationship is very complicated.     

我国流动人口管理模式多元化探究

上个世纪70年代末,我国出现了农村劳动人口向城市涌入的人口流动大潮。农村人口流向城市,一方面减轻了农村剩余劳动力给土地带来的沉重压力,另一方面也为经济社会发展提供了大量的劳动力资源。虽然数量庞大的流动人口为城市的经济发展和繁荣做出了巨大贡献,但也给城市管理带来了巨大的挑战。对此,各地政府都在积极探索新型的流动人口管理模式。本文在对这些探索作简要梳理的基础上,探讨了我国流动人口管理模式创新的基本路径,以期为流动人口管理模式的创新尽微薄之力。     

民事恶意诉讼的司法规制——以我国新《民事诉讼法》为中心的考察

民事恶意诉讼具有诉权行使的表面特征,但却隐含着非正当的目的追求。由于诉权是公民权利救济和启动国家司法权的中介,民事恶意诉讼司法规制的正当性需要从公民诉权保障和限制之间的平衡中加以探寻。我国《民事诉讼法》确立了以诚信原则为基础,以串通型恶意诉讼规制为中心,以第三人撤销之诉为辅助的规制恶意诉讼的制度体系,但恶意诉讼的界定、类型化以及审查程序等重要问题仍旧存在不同程度的欠缺。针对现有制度之不足,民事恶意诉讼的司法规制尚需要从实体规则和程序规则两方面进一步进行完善。     

马克思主义中国化方法论研究的争鸣和探讨

当前国内学界就马克思主义中国化研究的方法论问题展开如下热烈讨论和争鸣：1.实践优先还是理论与实践并重？2.整体性研究或是分科性研究？3.文本研究还是问题研究？4.历史唯物主义研究还是非历史唯物主义研究？5.政治性研究与学术性研究能否并存？这些问题的梳理将有助于马克思主义中国化的研究进一步深化。
