潘平格"致知格物"的经世实学思想

潘平格人生哲学的宗旨是"求仁",他对孔子的"仁"作了新解,由"泛爱众"推广到了爱天地万物。提出了"浑然天地万物一体即是仁"、致知格物、笃志力行为主要内容的"求仁"学说,是当时独树一帜的经世实学思想。他认为人们只有而且应当通过在人伦日用中的主观努力来实现自己这种"求仁"的本性,从而创造出人人饱暖、家家团聚的和谐的理想社会。同时,他对宋明理学中最关键的概念"格物"进行了全新的诠释,提出"物"是身家国天下,"格"是功及百姓,"格物"是贯修身齐家治国平天下为一事。因此,他提出了"笃志力行"的道德实践论。在他看来,不仅孔子、孟子,就是一般老百姓也可以成为圣人。这种圣凡等价的价值取向,是对中国封建社会关于人的等级价值观的否定。

律师服务业是现代服务业一个重要组成部分。黄浦,作为上海市的中心城区,优越的地理位置和深厚的历史积淀给区域经济的发展带来了令人振奋的机遇和前景,同时对黄浦现代法律服务业不断提出了新任务和新要求。随着律师管理服务工作重心的下移,如何在实践中运用科学发展观,积极履行司法行政工作职能,指导我区律师业进一步发展,拓展和规范法律服务,做和谐社会的建设者、保障者;如何在司法行政管理、律协行业管理、事务所及律师自律相结合的体制下,充分运用地域优势,促进黄浦律师业又好又快发展,已成为我们面临的新课题。     

Expressions of IL -1α, IL -1β and IL -13 mRNA in Lung Tissue and Serum of Rats Drown in Fresh WaterCSCD

Objective: To detect the changes of (interleukin, IL)-1α, IL-1βand IL-13 mRNA in lung tissue and serum of drown rats, and to explore the potential value for the diagnosis of drowning in forensic practice. Methods: Eighteen SD rats were randomly divided into drowning group, blank control group and myocardial infarction group (as control group). The serum of right ventricular, the inferior lobe of right lung and the myocardium were taken from the rats in different groups. The expressions of IL- 1α, IL-1βand IL-13 mRNA in the lung tissue and the serum of right ventricular were detected by TaqMan probe method. Results: The expression differences of IL-1α, IL-1βand IL-13 mRNA in lung tissue between drowning group and blank control group, myocardial infarction group were not statistically significant (P>0.05). The expression of IL-1βand IL-13 mRNA in serum of right ventricular increased (P<0.05). The expression differences of IL-1α, IL-1βand IL-13 mRNA in serum between blank control group and myocardial infarction group were not statistically significant (P>0.05). Conclusion: The changes of cytokines IL-1βand IL-13 mRNA in the serum of right ventricular of drown rats are statistical significance, which are highly correlated with drowning. © 2018 by the Editorial Department of Journal of Forensic Medicine.

156例重复违法的精神障碍患者特征分析

目的对重复违法的精神障碍患者的犯罪学、临床学、监护情况等特征进行分析,为预防其重复违法行为的发生提供参考依据。方法采用自制问卷表,对2007—2011年在四川大学华西法医学鉴定中心进行司法精神病鉴定的156例重复违法的精神障碍患者进行登记及分析。结果重复违法者中,男性、26~45岁、初中及以下文化程度、未婚者居多,农民和无业为主。人均违法3.26次,案件类型以故意伤害(34.6%)、杀人(15.7%)为主。56.4%的患者在发病5年以内出现首次违法行为,55.8%的患者在首次违法行为后的1年内出现再次违法。精神障碍的诊断多为精神分裂症(63.5%)。评定以无责任能力(61.5%)者为主。44.9%的患者从未接受过治疗,34.6%的患者无人监管。首次违法行为之后未进入法律程序的占66.0%,申请进行精神疾病鉴定的仅7.1%。结论重复违法的精神障碍患者多为低文化、低收入群体,就诊率低,监管力度不严。为有效预防精神障碍患者再次违法行为的发生,需构建良好的精神疾病治疗监管体系。     

税务和解对行政和解的扩张——以案件范围为中心

《税务行政复议规则》第八十六条和《行政复议实施条例》第四十条均是对和解的案件范围的表述.通过从这两个有关和解范围的条文对比,不难看出税务和解较行政和解有扩张之趋势,税务和解作为税务行政机关纠纷解决的内部机制,其扩张必然会对司法审查和纳税人权利保护产生相当大地冲击,对其必须加以限制.     

中越贸易人民币结算模式问题研究

目前,“地摊银行”结算占据中越边境贸易结算的主导地位,而一般贸易结算很大程度上还需要借助美元来完成整个操作流程。本文基于结算模式视角,具体探析中越贸易结算状况,提出“现行结算模式不是标准化的模式”这一观点。结合近年推出的人民币跨境贸易结算进程,从短期看,可以考虑建立中越货币自由兑换试验区;从中长期看,需要建立统一、高效的中越双边清算体系,进一步提升人民币的竞争力并逐步实行人民币自由兑换,从而推进人民币在东盟的区域化。     

The genetic and environmental overlap between aggressive and non-aggressive antisocial behavior in children and adolescents using the self-report delinquency interview (SR-DI)

Purpose

This study investigated genetic and environmental commonalities and differences between aggressive and non-aggressive antisocial behavior (ASB) in male and female child and adolescent twins, based on a newly developed self-report questionnaire with good reliability and external validity -- the Self-Report Delinquency Interview (SR-DI).

Methods

Subjects were 780 pairs of twins assessed through laboratory interviews at three time points in a longitudinal study, during which the twins were: (1) ages 9-10 years; (2) age 11-13 years, and (3) age 16-18 years.

Results

Sex differences were repeatedly observed for mean levels of ASB. In addition, diverse change patterns of genetic and environmental emerged, as a function of sex and form of ASB, during the development from childhood to adolescence. Although there was some overlap in etiologies of aggressive and non-aggressive ASB, predominantly in shared environmental factors, their genetic overlap was moderate and the non-shared environmental overlap was low.

Conclusions

Taken together, these results reinforced the importance of differentiating forms of ASB and further investigating sex differences in future research. These results should be considered in future comparisons between youth self-report and parental or teacher report of child and adolescent behavior, and may help elucidate commonalities and differences among informants.
