高校学生伤害事故适用公平责任原则的分析--从我国相关立法视角所作的思考

公平责任原则能否适用于高等学校学生伤害事故,一直是高等学校学生伤害事故归责原则研究和适用中争议的焦点之一。争议在理论研究、司法实践和地方立法中的对立,实际是民法学界公平责任原则存废争议的延伸,源自对《民法通则》实施以来我国立法、司法解释,特别是《侵权法》相关规定的不同解读。对此所作的分层分析表明,我国法律既没有肯定公平责任原则的法律定位,也不存在公平责任原则适用于高等学校学生伤害事故的规定。“公平责任原则”只能作为归结法律责任以外社会责任的一项损害分担规则。

论20世纪以来中国红色文化的嬗变与重构

20世纪以来的中国红色文化经历了精英文化、区域文化、大众文化、主流文化等不同形态的嬗变与重构.革命时代,红色文化从五四新文化运动和党的创立时期的精英文化,演变为区域性的苏区文化、抗日根据地文化、解放区文化;社会主义革命和建设时期,红色文化一跃而为主流文化;改革开放新时期,红色文化的资源属性得到全面释放,红色文化成为社会主义先进文化的重要组成部分.     

猪巨细胞病毒gB基因优势抗原表位区的原核表达及间接ELISA方法的建立

扩增了猪巨细胞病毒(PCMV)gB基因的优势抗原表位区,将构建成功的gB基因优势抗原表位区原核表达重组质粒(pET32a-gB)转化入表达菌Rosetta(DE3)中进行表达,以表达的重组蛋白作为包被抗原建立了一种检测PCMV抗体的间接ELISA方法,并对该间接ELISA检测方法进行了优化。结果显示,最佳抗原包被浓度为1.9μg/mL,最佳血清稀释度为1∶160,二抗最佳稀释度为1∶10 000;当样品D450nm≥0.26时判为阳性,当样品D450nm<0.215时判为阴性,介于两者之间时判为可疑。用该间接ELISA方法对138份PCMV阴性血清与240份PCMV阳性血清进行检测的结果显示,它的特异性为97.83%,敏感性为97.9%,变异系数均小于10%。用该ELISA方法和Western-blot对184份临床样品进行检测,结果二者的符合率为92.4%。结果表明,该间接ELISA方法简便快捷,具有良好的特异性、敏感性及重复性,适用于对PCMV抗体的大规模检测。     

基于GEM模型的资源型企业可持续发展障碍因素分析

资源型企业可持续发展对于经济生产和生态保护具有重要意义。本文以GEM模型为分析框架,探讨了我国资源型企业可持续发展的障碍因素;通过进一步对各个因素的理论分析,找出了影响我国资源型企业可持续发展的"瓶颈";最后,针对我国资源型企业可持续发展的现状,提出相应的对策与建议。     

浅议空壳公司经济犯罪的治理

利用空壳公司实施的经济犯罪隐蔽性强、具体作案手法不断翻新。目前,我国存在诸多影响空壳公司经济犯罪治理的问题。对此,公安机关需要从加强信息分析、完善监管机制、消除作案动机等方面开展治理,探讨新形势下空壳公司经济犯罪治理面临的挑战、制约因素和应对之策。     

论政府应对突发事件防御体系中的能力建设

社会各种突发事件频繁发生,政府在处置这些事件中应处于主导地位,提高政府防御突发事件的能力具有很强的现实性。政府应对突发事件防御体系的能力包括突发事件的预防能力、控制能力和处置能力。建立突发事件防御体系,政府机关需要通过强化处突基础,健全保障能力;强化科学预测,健全预警能力;完善法规体系,健全应对能力;组织实训演练,提高实战能力。     

度冷丁滥用者尿中原体及其代谢产物的分析研究

本研究利用ＧＣ／ＭＳ（ＥＩ．ＰＣＩ）技术，在度冷丁滥用者尿中确认了６种代谢产物。并建立了ＧＣ／ＦＩＤ分析度冷丁及其代谢产物的方法。方法线性范围为０．１～２０μｇ／ｍｌ，变异系数小于１０％，最小检出量为５０ｎｇ／ｍｌ，适用于度冷丁成瘾者尿中含量的测定。     

多式联运：关于当代法律的评论

德国运输法的改革法案于 1998年 7月 1日生效。新法最主要的变化是为国内的各种货物运输方式 ,包括公路、铁路、内水和航空运输 ,制定了一套相同的法律规则 ,同时第一次为多式联运制定了规则。本文主要以德国法为对象 ,同时比较中国、荷兰和法国法 ,论述多式联运合同的定义 ,适用法律 ,责任限制等问题。     

Future U.S.-Russian Relations

Presidential changes in Russia and the U.S. may open new opportunities for improving increasingly important bilateral relations, but expectations are not high. With the elapse of the so-called Putin autocracy and the Bush unilateralism, U.S.-Russian relations are overshadowed by a new ＂Cold Word War,＂ if not a Cold War. The U.S. will continue to accuse Russia of running an autocracy in order to justify its own invasive foreign conduct and gain the moral high-ground. The two powers will be involved in a bitter struggle, alternating between offensives and defensives, containment and cooperation.
