论功能主义思想之于西方法社会学发展的影响

作为法学与社会学两个学科结合的产物,西方法社会学在建立和发展的过程中,深受西方社会学理论流派与方法论思想的影响,功能主义思想就是对西方法社会学影响较深的一例,它分别从以下几个方面推动了西方法社会学的发展:第一,功能主义思想的引入改变了传统法学研究中注重分析法律结构内在的逻辑一致性的思维惯习,提供了从法律与外部世界的关系来考察法律的"外部"视角;第二,功能主义思想提供了从法律与社会整体的联系来考察法律问题的系统的视角;第三,功能主义思想中对"功能"内涵更为全面的阐释丰富了法社会学中的法律功能研究。     

Economic resilience after the Great Recession: an examination of unreserved fund balance in Michigan counties

ABSTRACT

This paper examines fiscal slack, in the form of unreserved fund balance, as a tool used by local governments to enhance economic resilience. It adapts ecological, engineering, and organisational definitions of economic resilience and investigate their relevance to local financial management in the United States after the Great Recession in 2008. Using group-based trajectory modelling, we identify different strategies of fund balances used by Michigan counties. The change of fund balance does not delineate any pattern theorised by the resilience concepts. We also find different factors that motivate local officials to manage their fund balances differently. The study suggests a nuanced understanding of fiscal slack used by local governments for economic resilience that goes beyond unreserved fund balance.

论强奸罪应当废除——基于后现代女性主义立场的一种观点

后现代女性主义将强奸视为一种"语言"。借由"话语塑造主体"这一机制,男性在有关强奸的立法与司法仪式中被塑造为身体上的压倒性体力占有者,女性则具有了"可被强奸"的属性。女性在男权社会中被客体化的事实在强奸罪这一罪名中得到进一步强化。后现代女性主义主张的话语转换策略提醒我们应当跳出既有法律框架来思考防治强奸的对策,即可以考虑在社会条件成熟的时候,取消"强奸罪"这一法律语言,达到改变女性弱势地位,约束男权的扩张,抑制强奸行为发生的目的。至此,女性以主体地位进入法律史,性别平等得到实现。

议题性质、威胁认知、共同利益与“可合作安全”

通过合作促进安全的理念越来越成为国际社会的共识。但是，在当前的国际安全合作中，普遍存在“多愿望，少行动”的现象。由于安全概念的泛化，国际社会几乎在所有安全问题上都表达出希望通过合作的方式来解决问题的意愿。但实际上，很多安全问题不可合作。“可合作安全”的概念是基于议题性质、威胁认知和共同利益的一种预设的状态。对议题性质的认定是安全合作的前提条件。如果安全合作对象在议题性质的认定方面观点不一致，那么安全合作不可实现；反之，安全合作是可能实现的。在安全合作对象关于议题性质观点一致的基础上，安全合作主要受威胁认知和共同利益两个因素的影响。如果安全合作的对象彼此威胁认知越小，且在应对安全威胁方面的共同利益越多，那么安全合作越可能实现；如果安全合作对象彼此威胁认知越大，且在应对安全威胁方面的共同利益越少，那么安全合作越难实现、甚至不可合作。“可合作安全”在应对安全威胁的实践中，可以为有关部门在什么问题上合作、与谁合作等提供思路，使国际安全合作更具针对性和目的性。     

Aortic Dissection and Sudden Unexpected Deaths: A Retrospective Study of 31 Forensic Autopsy Cases

Acute aortic dissection (AAD) is the most common cause of sudden unexpected death related to aortic diseases. A retrospective study of 31 sudden unexpected deaths caused by AAD was conducted at Xi'an Jiaotong University Forensic Center from 2001 to 2012. We summarized the forensic characteristics of AAD and assessed the clinically diagnostic accuracy of AAD. The characteristics of sudden unexpected death due to AAD were male predominant (male: female = 6.7:1), relatively young with the mean age of 44, and predominance of type A dissection (77.4%). Cardiac tamponade was the most frequent cause of sudden death (87.1%). Of the 31 cases, 26 (83.9%) patients were not recognized clinically and were misdiagnosed with acute myocardial infarction, coronary artery disease, cholecystitis, acute gastroenteritis, renal/urinary lithiasis, or acute pancreatitis. In summary, AAD can be difficult to recognize, diagnosis is therefore sometimes delayed or missed. The medicolegal death investigation can help physicians have a better understanding of AAD.
