论政府社会管理的理论依据与机制创新——基于新兴媒体时代的视角分析

马克思主义空间理论为我们理解新兴媒体所构成社会空间的本质，探索政府社会管理实践机制提供了理论依据。针对新兴媒体构建的新型文化空间，要求政府创新社会管理运作机制，提高政府的空间引导能力与空间传播能力。针对新兴媒体构筑的新型交往空间，要求政府创新社会管理调控机制，提高政府的空间执政能力与空间对话能力。针对新兴媒体构造的新型政治空间，要求政府创新社会管理动力机制，提升政府空间引导能力和空间驾驭能力。     

Hearts of Darkness: white women write race

Abstract

In an effort to popularise the gas stove, boost sales and minimize the genuine and perceived dangers of using this volatile domestic appliance, late Victorian gas managers and stove manufacturers employed female cookery teachers to perform public demonstrations at trade exhibitions throughout the country. Eventually, these women comprised a special department of gas sales, calling directly on customers in their homes to offer personal instruction in the proper use and care of gas stoves. Part social workers, part salesgirls, the ‘lady demons’, short for lady demonstrators, moved between the traditionally gendered separate spheres of work and home, consciously constructing a professional image that reconciled the social tensions of this new occupation. They offer an early example of women's entrance into the corporate business world, the feminisation of consumption, and the combination of customer service with social welfare.

Confrontation and co‐operation in the Indian Ocean

The end of the Cold War has created new dangers and opportunities. The formation of an Indian Ocean Rim trading bloc has the potential to benefit some of the poorest people in the world. Regional maritime co‐operation could provide the catalyst for alleviating poverty on the Indian Ocean Rim by giving a spurt to incomes and employment from the seas.

行政机关执法主体不移交刑事案件的行政行为正处在人民检察院一般监督范围内,构建检察院监督行政执法主体不移交刑事案件的监督机制刻不容缓,其中,完善相关立法,建立行政执法与刑事司法相衔接的工作机制,调和行政机关自由裁量权与人民检察院法律监督权的矛盾是完善检察监督机制的有效保障。     

论行政诉讼起诉期限的适用范围——以行政诉讼类型化为视角

行政诉讼的起诉期限是比照民法上的除斥期间和诉讼法上的上诉期间进行设计和变造的，在性质上属于程序法上的法定期间，不能中断或者中止，特殊情况下才可申请延长或扣除被耽误的时间。起诉期限规定仅与行政诉讼中特定的诉讼类型相关，域外立法普遍针对行政机关作出的行政决定、命令规定了较民事普通诉讼时效短得多的行政撤销诉讼（司法审查）的普通起诉期限；而其他诉讼类型均未规定提起诉讼应当适用起诉期限的规定。我国现行立法关于起诉期限的规定具有撤销诉讼一体主义的特征，应从诉讼类型的角度完善起诉期限的规定。具体而言，撤销诉讼继续适用现行立法规定的起诉期限；由于拒绝行为产生的给付诉讼也应当适用起诉期限的规定，而消极不作为给付诉讼可以考虑适用公法上请求权的消灭时效（诉讼时效）或者权利失效制度予以规范；确认诉讼不需要规定起诉期限，而是通过诉的利益和确认诉讼的补充性规则防止原告滥用诉权。
