法的人本主义

近年来中国提出的以人为本理念,是中外历史上人本主义、民本主义的继承和发展,是当代人类文明发展中有关这一命题各种进步理念的高度概括和理论升华。它的具体内涵可归纳为如下十点:人的价值高于一切;人是目的,不是手段;人是发展的中心主体;促进人的全面发展;崇尚和彰显人性;坚持人的独立自主;尊重人的首创精神;权利优位于义务;权利优位于权力;尊重和保障人权。保障人权是现代法律的根本目的,以人为本应成为现代法律的根本价值准则。依据以人为本的科学内涵指导社会主义法治建设,可以将其概括为法的人本主义。     

困境与出路:生态补偿法律制度的完善路径

当前保护生态环境资源的形势严峻,经济发展与生态环境之间的矛盾日益加深,如何协调两者之间的关系以实现利益平衡,需对生态补偿问题进行探讨。本文阐明生态补偿的内涵,分析生态补偿立法中存在的问题,提出完善生态补偿的具体措施,以期为构建可行性的生态补偿制度提供借鉴。

中德(日)量刑基准之比较研究

在德日刑法中,受责任主义的规制,责任为刑罚规定了前提和界限,基于预防方面的考量不能僭越责任程度所决定的刑罚。相比之下,中国现行刑法的量刑基准理论与之虽貌合实神离,因为作为其量刑基准的刑事责任的大小是社会危害性与人身危险性评价的加权之值。我国现行量刑基准理论实际上是现行刑事责任理论体系的逻辑延伸。欲求我国量刑基准理论在逻辑上更为科学合理,在价值取向上彰显现代刑法之人权保障机能,则必以改善现行刑事责任理论体系为前提。改造的重点在于纠正将责任评价与刑罚量定混为一体的做法,将之予以分离,使之各得其所。作为犯罪后果负担的刑事责任只能由犯罪的严重性程度来决定,人身危险性因素不能用于评价犯罪与刑事责任,而只能在刑罚最后量定时做有利于犯罪人更新改造之缓和考量。     

Universal Periodic Review： Development of the United Nations＇ Human Rights Monitoring Mechanism

On March 15, 2006, the United Nations General Assembly adopted Resolution 60/251 to create a 47-member Human Rights Council （the Council） in replacement of a 60-year-old Commission on Human Rights （the Commission）. The Universal Periodic Review （UPR） is an important mechanism and power that the resolution imparted to .the Council. It ensures that all UN member states are subject to review in their fulfillment of human rights obligations and commitments. Generally, as an institute trader guidance of the UN General Assembly to coordinate the UN human rights activities, the Council has undergone considerable changes and development from its predecessor the Commission in its responsibilities,
