"仇必和而解"是张载颇为特别的观点.两种辩证法一般指客观辩证法和主观辩证法,但在现代新儒家哲学,又有所谓"仇必仇到底"与"仇必和而解"两种辩证法之说,将张载的辩证法与矛盾辩证法对立起来.本文指出,冯友兰先生对张载思想的理解和片面性的概括不符合张载思想的原貌;提出并不存在冯氏意义的"两种辩证法"的对立,张载的"仇必和而解"只是矛盾辩证法的一个发展阶段和一定表现形式.     

论海运条约冲突的解决模式——以联合国货物运输法草案为中心

针对联合国货物运输法草案诞生后海运条约冲突存在的必然性,分析草案制定历程中先后公布的6份文本所呈现出的三种海运条约冲突解决模式:回避模式、优先模式和退约模式。认为回避模式太消极,应首先予以排除;优先模式和退约模式,均只能解决部分条约冲突,同时没有虑及未来新的条约。提出改进之途在于应一并考虑后法优于前法原则、善意履约原则、条约相对效力原则,同时适当运用条约优先地位条款。

针对当前高层建筑消防严峻形势及火灾威胁的现实问题,分析了高层建筑的火灾特点以及高层建筑产生火灾的原因,探讨了自防自救、严格执法、消防设计、日常消防管理、安全疏散、逃生训练与演习对于超高层建筑火灾防控的重要性和难点。结合高层建筑火灾成因,提出从加强消防监督管理,增强消防设施建设及建筑材料的选择,建立火灾防控安全体系,实战演练,建立火灾应急体系及大力发展火灾科学基础研究,加强国际间的交流与合作等方面着手,立足自助互救,以减少伤亡损失。
