Abstract:  The draft Constitution was an attempt to democratise the EU, while taking account of the problematic social preconditions for democracy at the Union level. Its failure demonstrates the need to pay greater attention to the nature of public support for the EU, and to the ways in which this support is related to the democratic quality of EU institutions. Contrary to what is often assumed, EU support can still be quite adequately described by the figure of a 'permissive consensus'. For better or worse, attempts to democratise EU institutions might undermine this form of support.  相似文献

This article examines the state of media regulation in Arab and other Muslim countries. Whereas most countries in Europe, including the emerging democracies of Central and Eastern Europe, and some of the African societies in transition have developed media commissions of different types, most Muslim countries are so far reluctant to ease the dominating state control of the media, especially in the audiovisual sector. A majority of journalists associations in the Middle East and North Africa still need to distance themselves from governments and ruling parties. Their major task is to ensure observance of ethical standards, a task in which they have to struggle with the desires of governments and parliaments to make excessive use of the judiciary to sanction journalists. So far, Muslim countries have yet to develop their own models for restructuring the changing media sector and for creating a viable system of checks and balances that would control the media in a democratic way. Governments should aim to develop a common understanding among regulatory bodies and media practitioners and thus to provide for common concepts of ethical standards. In these efforts, much can be learned from the wide range of experiences gained by the transitional societies of Eastern Europe and sub-Saharan Africa during the last decade.  相似文献

This essay deals with the allocation of genetic resources with regard to property-rights theory. In addition to this, different arrangements of property rights will be examined as to their allocation and distribution effects. The result will show that property rights on biological diversity can only cover patrimonial rights which contain the right to use the resource but not to destroy it. Bioprospecting conventions, such as the well known Merck-INBio agreement, will be examined as mechanisms to establish property rights in terms of biological diversity. Moreover, the identification of these agreements will be critically questioned for their applicability as a form of the Coase-theorem.  相似文献

Abstract: While ballistic parameters of vole captive bolt devices have been reported, there is no investigation on their hazardous potential to cause noise trauma. The aim of this experimental study was to measure the sound pressure levels of vole captive bolt devices. Two different shooting devices were examined with a modular precision sound level meter on an outdoor firing range. Measurements were taken in a semi‐circular configuration with measuring points 0° in front of the muzzle, 90° at right angle of the muzzle, and 180° behind the shooting device. Distances between muzzle and microphone were 0.5, 1, 2, 10, and 20 m. Sound pressure levels exceeded 130 dB(C) at any measuring point within the 20‐m area. Highest measurements (more than 172 dB[C]) were taken in the 0° direction at the 0.5‐m distance for both shooting devices proving the hazardous potential of these gadgets to cause noise trauma.  相似文献

In this article, we will further the explanation of the state's changing role in health care systems belonging to the Organisation for Economic Cooperation and Development (OECD). We build on our analysis of twenty-three OECD countries, which reveals broad trends regarding governments' role in financing, service provision, and regulation. In particular, we identified increasing similarities between the three system types we delineate as National Health Service (NHS), social health insurance, and private health insurance systems. We argue that the specific health care system type is an essential contributor to these changes. We highlight that health care systems tend to feature specific, type-related deficiencies, which cannot be solved by routine mechanisms. As a consequence, non-system-specific elements and innovative policies are implemented, which leads to the emergence of "hybrid" systems and indicates a trend toward convergence, or increasing similarities. We elaborate this hypothesis in two steps. First, we describe system-specific deficits of each health care system type and provide an overview of major adaptive responses to these deficits. The adaptive responses can be considered as non-system-specific interventions that broaden the portfolio of regulatory policies. Second, we examine diagnosis-related groups (DRGs) as a common approach for financing hospitals efficiently, which are nevertheless shaped by type-specific deficiencies and reform requirements. In the United States' private insurance system, DRGs are mainly used as a means of hierarchical cost control, while their implementation in the English NHS system is to increase productivity of hospital services. In the German social health insurance system, DRGs support competition as a means to control self-regulated providers. Thus, DRGs contribute to the hybridization of health care systems because they tend to strengthen coordination mechanisms that were less developed in the existing health care systems.  相似文献

In order to illuminate the consequences of extra votes for parents, this article looks at the questions of whether parents differ in their party choice from younger people and of what the overall results would have been like for German Bundestag elections in 1994–2005. The results can be summarised as follows: (1) In simple comparisons, parents and childless people have not differed a lot in their party preferences since the first half of the 1990s. However, a more complex analysis of the 2005 elections brought to light systematic differences that are contingent on voters’ age and on their region. (2) The aggregate results of the 1994 to 2005 elections would have looked very much the same. Thus, no party would profit per se in electoral terms from the introduction of the proxy vote for children.  相似文献

This article assesses the determinants of the subjective voting norm with the European Social Survey 2002/3 for 21 European democracies. The empirical procedure tests various combinations of four theoretical perspectives: (1) social integration, i.e., the extent and quality to which an individual is integrated into given social contexts, (2) social trust, i.e., the general willingness to cooperate with other individuals, (3) the support of the social system to which the norm belongs, and (4) the perception of the degree of compliance and the quality of a social norm in an individual’s context. The best explanation is offered by the model which combines social integration, the support of the social system and the perception of the degree of compliance and quality of the norm. We also examine additional causal paths of indicators of social integration through system support on the individual voting norm. The paper contributes to an improvement on existing literature through its more complex causal modelling and the placing of individual attitudes in context.  相似文献
