A Trojan horse: Anti-communism and the war on drugs

This work argues the U.S. War on Drugs is a misnomer. We suggest, instead, that it is secondary to traditional anti-Communist foreign policy concerns. Thus, the war on drugs serves to mask the U.S. counter-intelligence and paramilitary presence abroad.This paper in slightly different form was originally presented at the meeting of the Drug Policy Foundation, Washington, D.C., October 1988.     

Broadening the Evaluation of Dispute Resolution: Context and Relationships Over Time

Evaluation of negotiation outcomes tends to focus on measurable, dyadic,short-term resolutions of conflict. We review current challenges to this traditionalmodel of the evaluation of dispute resolution outcomes, and we offerfour perspectives that can help address them. First, we advocate the needfor longitudinal studies of negotiations that incorporate disputant relationshipsbefore and after a particular negotiation. Second, we highlight theincreasing importance of third parties in resolving conflict. Third, we suggesta more comprehensive conception of parties, relationships andoutcomes in negotiations research. Finally, we advance an explicit incorporationof context and culture into dispute resolution research models.     

An approach to evaluating adolescent adaptive processes: Validity of an interview-based measure

Constitutional Theories and Constitutional Rights: Federalist Considerations

This article examines the contemporary controversy over constitutionalinterpretation and the differing understandings of constitutionalrights that underlie it. We first consider the character andbasis for interpretivism, that is, a jurisprudence that delineatesrights by reference to the intent of the founders and to theconstitutional text. Next, we review the non-interpretivistalternative, focusing on Ronald Dworkin's influential accountof constitutional rights. We conclude that despite its strengths,Dworkin's position does justice neither to the constitutionaltext nor to the connection between structure and rights in theUnited States Constitution. Finally, considering constitutionaltheory from the broader perspective of state constitutionalism,we conclude that its insights are limited to the U.S. Constitutionand offer some suggestions for a more adequate constitutionaltheory.     

Retaining rights in your own name

This case concerned the question of whether an individual whosells the rights in their name can challenge the ownership ofthose rights on the basis that its use would be deceptive.     

Research malpractice and the issue of incidental findings.

Human subject research involving brain imaging is likely to reveal significant incidental findings of abnormal brain morphology. Because of this fact and because of the fiduciary relationship between researcher and subject, board-certified or board-eligible radiologists should review the scans to look for any abnormality, the scans should be conducted in accordance with standard medical practice for reviewing the clinical status of the whole brain, and the informed consent process should disclose the possibility that incidental findings may be revealed and what consequences will follow. In the event such findings are revealed, qualified physicians should explain to the subject the significance of the findings and the alternatives available.     

Interpretation of blood alcohol concentration in maritime accidents—A case report

The human element is increasingly acknowledged as an important factor contributing to accidents at sea. Alcohol and drug abuse is becoming an increasing problem among seafarers in the last few years. Recently we registered a few similar maritime accidents on the Adriatic coast. During the analysis of these incidents, it became apparent that the consumption of alcohol on duty was the main cause of the ship being stranded. We report a maritime accident recently happened in port of Rijeka, where the merchant ship stranded on the main breakwater. During the investigation, forensic alcohol analysis established that master's consumption of alcohol on duty was the main cause of the incident. The BAC–UAC relation we found was not physiologically possible, so further diagnostic workup demonstrated that urine was diluted. Various issues are being discussed, such as urine dilution, retrograde calculation, elimination rate, two subsequent blood samples, drinking after the accident, as well as prevention measures. Our observations indicate a need for stricter and more precise legislation as well as more frequent police control that will hopefully result in prevention of serious maritime accidents caused by alcohol consumption. In our opinion, better understanding of the above mentioned apparent problems in navigation rules and maritime law regulations can prevent similar accidents from happening in the future. Accidents like the one described cause double damage for society: due to acute health problems of the crew and navigation safety, as well as due to the long-term harmful consequences such as suspension of career on ship board and early retirement of employees.
