Mental disorder as the cause of a crime

An offender's punishment can be reduced when a court decides that his mental disorder reduces his responsibility for what he did. Courts have sought to establish whether a mentally disordered offender's responsibility is reduced by asking whether his disorder caused the crime. Acceptance of this “causation by mental disorder” criterion has fluctuated, however. This may be because causal explanations are not the types of explanations we are accustomed to offering for the kinds of acts that bring defendants, and psychiatric witnesses, to court. More often, we offer what philosophers have called “possibility” explanations for these acts. The application of psychiatry to possibility explanations has not been widely explored. It offers the potential for the improved use of psychiatric evidence in criminal proceedings.     

Immigration and integration policy and the Austrian radical right in office: the FPÖ/BZÖ, 2000–2006

This article focuses on the radical right's influence on immigration and migrant integration policy by scrutinising the 6-year period in national government of the Austrian Freedom Party and Alliance for Austria's Future. Specifically, it investigates the radical right's influence on migration control, migrant integration, citizenship and asylum policy. While previous studies have often credited the Austrian radical right with policy influence, it is argued that such work ignores both the problematic adjustment of the radical right to public office and the insights of immigration policy theory. By integrating these criticisms into the analysis, it is argued that although immigration policy was restrictive, the policies pursued did not deviate too greatly from past and subsequent government policy nor with the policies being implemented elsewhere in Europe. Furthermore, the radical right's influence on immigration policy was limited by the role of intra-coalition dynamics and the moderating effect of the policy process.

Underpinning success in the real world of corporations law

This paper reports on an action research project which sought to evaluate and guide ongoing teaching and learning development in Principles of Corporations Law, a semester-long unit of study. Typically, enrolments in this subject area include students from a range of cultural contexts for whom the legislative and administrative concepts of the unit are unfamiliar and who also experience significant difficulties with cultural conventions of communication and business practice. At our university, unit enrolments include a high proportion of distance education as well as non-English speaking background (NESB) students, predominantly from China, who have not studied units formerly considered as prerequisite, and many of whom experience difficulties with basic academic skills. As the development team planned and created teaching features to ensure better learning outcomes for these students, it was clear that some truly contextual thinking as well as some practicable solutions would be required. While we had determined in the redesign planning that scenario- or problem-based learning (PBL) with its emphasis on finding, understanding and using information in context, was best suited to help students acquire the skills that underpin success in the unit, our experience in the project indicated students had a broader range of more basic needs. It emerged that students were struggling with fundamental issues that would need to be addressed before real change could occur.
