The 1968 Movement Revisited: Education and the Distinction in Values,Political Interest and Political Participation in West Germany

The aim of this paper is to take a look at the 1968 generation in West Germany about 40 years after the 1968 events. Whether there was a 1968 generation in the narrow sense of the word will be explored. While comparing the 1968 generation with earlier and later cohorts, political interest, political activity and (postmaterialist) values will be analysed. Education will be theorised as a main mechanism that distinguishes the 1968 generation from earlier generations. Quantitative analyses will be performed employing a temporal perspective and including age, period and cohort effects – so that socialisation as well as individual change over the life cycle and macro influences can be taken into account. The results show a strong influence of education on political interest, political activity and postmaterialism. Therefore, what is called the ‘1968 generation’ only applies to the more highly educated people of this generation.     

On the Electoral Relevance of Education Policy in the German Länder

Education policy in Germany experienced a boom throughout the 2000s. Numerous reforms were implemented, quite far-reaching shifts of party programmes occurred, and the scope of institutions with an educational mandate widened considerably. At the same time, Landtag elections came to be seen as less dominated by federal politics. Yet we still know little about education policy's electoral relevance. The present article, following a most-likely design, analyses those five Landtag elections that were held since the reform of federalism in 2006 for which the importance of education policy ought to have been highest. It turns out that even though education is one of the very few policies which the Länder can decide upon autonomously, and despite the recent upsurge of regional factors in determining the outcomes of such second-order elections, nearly all Landtag elections are won or lost on other battlefields.

Alternative Verursachungskonkurrenz mit dem Zufall – Die Wahrscheinlichkeit als Haftungsgrund?

Der Arbeitsgruppen-Entwurf eines neuen ?sterreichischen Schadenersatzrechts sieht vor, dass die Verursachungskonkurrenz mit dem Zufall zu einer Anteilshaftung führt. Die Verfasser des Entwurfs konnten sich dabei an der hM orientieren. Deswegen wird im Folgenden die alternative Konkurrenz mit dem Zufall auf der Grundlage der lex lata beurteilt, um den Ausgangspunkt des Entwurfs bewusst zu machen. Dabei wird gezeigt werden, dass die hM mit dem geltenden Recht nicht vereinbar ist. Die ge?u?erten Bedenken sprechen überdies gegen eine Normierung der Anteilshaftung im Zuge der Reform des Schadenersatzrechts.     

Zinsminderung – Leerstehungen in einem Einkaufszentrum

Bei einem Bestandvertrag in einem Einkaufszentrum k?nnen umfangreiche Leerstehungen Anlass für eine Mietzinsreduktion sein, dies gilt auch für sog multifunktionale Zentren. Allerdings kann ein bestimmter Prozentsatz an Leerstehungen, ab dem Zinsminderungsansprüche bejaht werden k?nnen, nicht festgesetzt werden, weil die Verletzung des bedungenen Gebrauchs eines Bestandobjektes immer von den Umst?nden des Einzelfalles abh?ngt.     

Ausübung eines vertraglichen Weitergaberechts in Konkurrenz mit einem Tatbestand nach § 12a Abs 3 MRG

Mangels ?nderung in der Person des Mieters in den F?llen des § 12a Abs 3 MRG findet keine Vertragsnachfolge statt, sodass die Ausübung eines vertraglichen Weitergaberechts in den F?llen einer blo?en ?nderung der wirtschaftlichen und rechtlichen Einflussm?glichkeiten nicht an eine empfangsbedürftige übertragungserkl?rung geknüpft werden kann. Der Mieter kann vielmehr auch nach Verwirklichung des Machtwechsels einem auf § 12a Abs 3 MRG gestützten Erh?hungsbegehren des Vermieters den rechtsvernichtenden Einwand der Inanspruchnahme des vertraglichen Weitergaberechts entgegenhalten.     

Psychological Aspects of Property and Ownership

Although property lawyers and theorists were always interested in the legal doctrinal construction of property rights and in political, moral, or economic justifications of property rights through the course of history, they very rarely looked into possible psychological roots of property rights and the powers they entail. Similarly, psychologists (whether with a focus on individual or social psychology) provide models for the explanation of a person’s behaviour and the social interactions of humans, but they rarely touch upon property rights at all, and if so, only in brief passing comments. The one extensive study on the social psychology of property appeared 75 years ago. This paper looks into modern research of individual and social psychology and assesses whether some of the findings can be used to explain a psychological basis for the existence and importance of property rights. That may also be a starting point for a modern interdisciplinary study in this area.
