Climate change litigation is an obsessive preoccupation for many legal scholars. Three different “narratives” can be identified for why scholars find such litigation important to study: litigation is a response to institutional failure, legal reasoning holds authority, and litigation is a forum for the co‐production of facts and social orders. The nature and consequences of these narratives are considered in the context of the first U.S. Supreme Court “climate change” case—Massachusetts v. EPA (2007). This analysis has implications for both how scholars understand their expertise in this area, and how they should foster it. 相似文献

This study disentangled the effects of intimate relationships and parenting on women probationers’ noncompliance. Data from a sample of 257 women were analyzed using logistic and negative binomial regression. Women with nonconforming intimate partners missed treatment more frequently, had a higher likelihood of missing a probation appointment, and had a higher chance of a new arrest for substance abuse or misdemeanor crimes during a 3-year follow-up period. Women parenting children had fewer missed probation appointments. Missed probation appointments increased the risk of recidivism for all crime categories except driving under the influence. Cognitive-behavioral treatment programs for adult sex offenders often include training geared to improve a perpetrator's social problem-solving skills. However, little empirical evidence exists to date that documents the relationship between problem-solving and deviant sexual interest or behavior among child molesters. As such, this study investigated the association between problem-solving and two aspects of sexual offending—self-reported sexual deviancy and clinician-rated sexual aggression among a recruited sample of incarcerated child molesters. To minimize the potential for biased self-reports, criterion scores on a lie scale were employed to exclude individuals who might be prone to misrepresent their responses. Results indicated this sample to be characterized by significant deficits on all measures of social problem-solving as compared to the general population. In addition, a series of correlational analyses indicated that an avoidant problem-solving style was significantly associated with past sexual aggression, whereas a negative problem orientation and an impulsive/careless problem-solving style were significantly related to a measure of current sexual deviancy. Of particular interest is the finding that a rational problem-solving style (i.e., the constructive style that involves the systematic application of specific problem-solving skills geared toward identifying an effective solution) was not significantly related to either sexual offending measure. Background. We examined the effect of a second interviewer's demeanour on cues to deception. We predicted that a supportive demeanour would be the most beneficial for eliciting verbal cues to deceit, as it would encourage truth tellers, but not liars, to say more. In addition, we examined the extent to which interviewees deliberately made eye contact with the interviewers. Liars take their credibility less for granted than truth tellers, and therefore have a greater drive to be convincing. Liars are thus more likely to monitor the interviewer to determine if the interviewer appears to believe them. Method. Participants appeared before two interviewers: the first asked all the questions and the second remained silent. The second interviewer exhibited either a supportive, neutral, or a suspicious demeanour. Results. Truth tellers provided significantly more detail than liars, but only in the supportive second interviewer condition. The effect of a second interviewer's demeanour on detail was perhaps remarkable given that the interviewees hardly looked at the second interviewer (less than 10% of the time). Liars displayed more deliberate eye contact (with the first interviewer) than truth tellers did. Conclusions. A supportive second interviewer has a positive effect on interviewing. We discuss this finding in the wider contexts of investigative interviewing and interviewing to detect deception. 相似文献

Slovakia distinguished itself in the first half of this decade by launching a coherent set of economic reforms that limited government and transferred social and economic risk to individuals. We examine reforms in fiscal policy, pensions, the labour code, health care, investment, education and justice. While the surprise formation of a centre – right governing coalition in 2002 enabled Slovakia's ‘neoliberal’ turn, a close network of neoliberal policy makers and advisors from civil society organisations used the opportunity to push forward a compelling explanation of Slovak economic problems and promote a clear institutional design for fixing them. 相似文献
