Part of the conventional wisdom about the United States Supreme Court is the presumed existence of a freshman effect, a distinct pattern of behavior thought to be associated with newly appointed justices. Among other things, freshman justices are thought to be less likely than their senior colleagues to vote with established ideological blocs on the Court. The empirical evidence for the freshman effect in voting on the Court is somewhat ambiguous, however. In order to test for a freshman effect in the voting behavior of new justices on the Supreme Court, we examined the behavior of all justices on the Court between 1921 and 1990. Voting blocs were determined from the justices' interagreement scores, using the widely employed criterion developed by Sprague (1968). We found no evidence of a freshman effect during the time frame under study. Freshman justices do not differ from their senior colleagues with respect to bloc voting. We conclude that the freshman effect hypothesis is erroneous, at least with respect to the supposed nonalignment behavior of neophyte justices.  相似文献

This essay attempts to explore trademark law and the marks themselves from a semiotic viewpoint to provide a deeper understanding to (trademark) law as a system of signs. Although the language of trademark law may suggest slightly different meanings, for the purpose of this essay “trademark” will refer to an area of law (unless otherwise indicated) and “mark” will refer to the individual sign. The first part of this essay will provide a brief overview of semiotics. Second, it will outline a general look at trademark law as set forth in the Lanham Act. The third section is a semiotic approach to provide a deeper understanding of trademark law. Finally, the essay will analyze a seminal trademark case whilst using semiotics to address legal meaning within the case. Semiotics teaches that no absolute meaning can be found. This essay, then, attempts to secure at least one particular meaning of the Qualitex case and what it means in trademark law today.  相似文献

Law enforcement personnel (LEPs) experience occupational stressors that can result in poor health outcomes and have a negative impact on the communities they serve. Dispositional mindfulness, or receptive awareness and attention to present moment experience, has been shown to negatively predict perceived stress and to moderate the relationship between stressors and negative stress-related outcomes. The current study is an investigation of the moderating role of specific facets of dispositional mindfulness (i.e., nonreactivity, nonjudging, and acting with awareness) in the relationship between occupational stressors and perceived stress in a sample of LEPs. As hypothesized, nonreactivity significantly moderated the relationship between operational stressors and perceived stress, such that LEPs low in nonreactivity exhibited a significant relationship between stressors and perceived stress, whereas those high in nonreactivity did not. Nonjudging also moderated the relationship between organizational stressors and perceived stress; however, unexpectedly, LEPs high in nonjudging evidenced a significant relationship between stressors and perceived stress, whereas those low in nonjudging did not. Potential implications of these findings for LEP stress reduction interventions are discussed.  相似文献

In this study, data is presented from a sample of 52 male domestic violence offenders who were court mandated to attend a profeminist psycho-educational rehabilitation program in the West Midlands. The extent of both statistically and clinically significant psychological change achieved across a variety of measures (pro-domestic-violence attitudes, anger, locus of control, interpersonal dependency) assessed pre- and post-treatment, and their association with post-treatment re-offending within an 11-month follow-up period is examined. The results indicate that program completers achieved limited significant psychological change. However, the level of psychological change achieved had no association with re-offending.  相似文献

The Institute for Community Peace has conducted two demonstration projects to determine whether communities can be engaged to prevent violence as it is identified and defined locally and link primary prevention across multiple forms of violence. The projects present evidence that community engagement can effect primary violence prevention; the violence prevention field has much to learn about developing and sustaining strategies to address interrelated violence problems; and the violence prevention field and community residents are in vastly different places with respect to primary violence prevention.  相似文献
