Peace is conceivable only as a legal order. According to Hans Kelsen, a legal order is by its very nature a ‘coercive order’. Thus, peace and coercion are not mutually exclusive, but refer to each other in the concept of law. In this contribution, we elaborate and problematize the paradoxical relationship between coercion and peace in theoretical and historical perspective. For this, we differentiate between arbitrary force and legal enforcement in the context of world-order politics. While we argue in favor of peace through law enforcement, we also emphasize the element of arbitrariness in the concept and historical formation of law. This is to say that the stabilization of peace through legal coercion goes hand in hand with its simultaneous destabilization. The text unfolds this dilemma with reference to the evolution of the theory and practice of legitimizing the use of force from past to present. We argue that the dilemma cannot be overcome, but it can be mitigated through the creation of a rule of law, which allows for a reflexive treatment of the tension between peace and coercion. 相似文献

Evaluations of public programs in many fields reveal that different types of programs—or different versions of the same program—vary in their effectiveness. Moreover, a program that is effective for one group of people might not be effective for other groups, and a program that is effective in one set of circumstances may not be effective in other circumstances. This paper presents a conceptual framework for research on such variation in program effects and the sources of this variation. The framework is intended to help researchers—both those who focus mainly on studying program implementation and those who focus mainly on estimating program effects—see how their respective pieces fit together in a way that helps to identify factors that explain variation in program effects, and thereby support more systematic data collection. The ultimate goal of the framework is to enable researchers to offer better guidance to policymakers and program operators on the conditions and practices that are associated with larger and more positive effects. 相似文献

Using 1971–90 panel data from a Siberian province, two econometric methods are used side by side to examine technical inefficiency with a suggestion as to how the methods might be used in sequence. Estimates derived from a random effects method reveal that technical inefficiency is both substantial and not time invariant. Results using either a random or fixed effects method suggest that existing estimates of technical inefficiency in centrally planned economies may be biased downward because of the choice of the estimation method. Using either method, the increasing technical inefficiency found is likely to be one cause of the decline in the performance of centrally planned economies and their regions. 相似文献
