Explaining “Market Authority” and Liberal Stability: Toward a Sociological–Constructivist Synthesis

Irrespective of the occasionally destructive financial consequences for individuals and the global economy, and warnings of its imminent collapse by critics, a globalising regime of capital mobility and neoliberal domestic policies appears in no danger of imminent collapse. This article explores the sources of the erstwhile stability of a liberal global economic order. The social mechanisms whereby people in many of the most capable states give their consent to “market authority” are explored with reference to Max Weber's sociology of legitimacy and Anthony Giddens' sociology of modernity. A constructivist theoretical construct of the changing “structure of intersubjective public belief” is developed as an explanatory heuristic. Liberalism is criticised for its conflation of choice with consent regarding its treatment of market processes, and vulnerabilities resulting from inconsistencies among liberal treatments of these are discussed.     

Legal Issues and Human Rights Dimensions of the Israeli Settlements Issue: Victims and Spoilers

The presenters on this panel discussed several important additional requirements for the successful implementation of a two-state solution that involves significant relocation of settlers. These requirements include balancing rights among different groups, minimizing the impact of "spoilers," and providing political compensation to settlers. Presenters also highlighted the relevance of elements of classic negotiation theory to this issue, including thinking creatively about substance and paying appropriate attention to process.     

How Green Was My Valley? An Examination of Tournament Theory as a Governance Mechanism in Silicon Valley Law Firms

The tournament model is a widely used mechanism to control opportunistic behavior by associates in law firms. However, this mechanism can only operate in certain economic (and social) circumstances. When those circumstances do not exist, the model breaks down, and with it the ability to control opportunism in the absence of some alternative mechanism. Prior research has not investigated whether the utilization of a tournament model prevents the opportunistic behaviors identified as grabbing, leaving, and shirking. In order to test the limits of the tournament model, it is necessary to find particular historical moments when the economic environment radically challenges assumptions/premises of the model. The dot-com bubble in Silicon Valley provides precisely such a time and place. This article demonstrates limits to the applicability of tournament theory. Those limits are to be found in the economic environment in circumstances in which: (1) exogenous reward structures offer many multiples of internal rewards; (2) demonstrably high short-term rewards outside the firm starkly contrast with the delayed long-term rewards inside the firm; (3) the managerial strata reduce their emphasis on long-term recruiting of potential partners in favor of short-term productivity by young associates; and (4) firms develop departmental leverage ratios in excess of their capacity to monitor, mentor, and train recruits.     

Economic and Sociological Correlates of Suicides: Multilevel Analysis of the Time Series Data in the United Kingdom

For the effects of social integration on suicides, there have been different and even contradictive conclusions. In this study, the selected economic and social risks of suicide for different age groups and genders in the United Kingdom were identified and the effects were estimated by the multilevel time series analyses. To our knowledge, there exist no previous studies that estimated a dynamic model of suicides on the time series data together with multilevel analysis and autoregressive distributed lags. The investigation indicated that unemployment rate, inflation rate, and divorce rate are all significantly and positively related to the national suicide rates in the United Kingdom from 1981 to 2011. Furthermore, the suicide rates of almost all groups above 40 years are significantly associated with the risk factors of unemployment and inflation rate, in comparison with the younger groups.     

Preclinical Assessment of Safety and Efficacy of Fluorescent Dye for Detecting Dermal Injuries (the injuries were both abrasions and incision) in a Murine Model

Objective documentation of tears and abrasions to the external genitalia after sexual assault is an important part of the forensic examination. A 1% aqueous solution of toluidine blue (TB) dye is often used to highlight injury, but the dye can be difficult to see on dark skin. We evaluated a fluorescent dye for detecting injuries on all skin colors in a relevant preclinical murine model. We compared the ability of trained, blinded observers to detect unstained wounds and wounds stained with 1% fluorescein sodium (FL) and with TB. We also evaluated the cutaneous wound healing response after application of both dyes. The no‐dye group had significantly fewer (p < 0.05) true‐positive identifications compared to all the dye groups. No differences in effectiveness were detected between dye treatments. All groups exhibited statistically similar healing rates. These findings support the evaluation of fluorescein sodium in a future clinical study with human subjects.
