Abstract. The reapportionment of congressional and state legislative districts occasioned by decennial censuses has generated intense political and judicial conflict. This conflict has made clearer several obstacles to a deeper understanding of the nature of representation. It has also led to the fashioning of a new equal protection jurisprudence by the Supreme Court in an attempt to grapple with apportionment disputes. The Court has established clear standards for redistricting congressional and state legislative seats. Yet after two decades, the Court has still not produced judicially manageable standards to deal with the problems of partisan gerrymandering, affirmative gerrymandering,'political fairness', and the Court's impact on public policy. A review of the pertinent cases makes it possible to forecast the probable outcome of litigation involving these issues in the 1980 round of reapportionments. 相似文献

The research explores variations in citations and evaluates various explanations for these variations, including the potential impact of individual judicial style, legal factors, and group interaction in the formation of opinions. Ecological analysis of crime rates has been a traditionally important approach to analyzing the causes of crime. Over the years, this approach has profited from the use of increasingly sophisticated data analysis techniques. A recent article in this journal on intracity crime rates offered such an analytic refinement—with the discovery of similar curvilinear relationships between both personal and property crime and customary socioeconomic predictors Such a finding for both types of crime is quite different from the results indicated in previous research. The present article reexamines comparable data on urban crime, adding further statistical and theory-based refinements to the analysis The results here show distinctive relationships for property and personal crime. This paper serves, then, to integrate careful empirical analysis into available criminogenic theory and into the conventional wisdom of ecological research. 相似文献

The UK government undertakes a variety of public consultation procedures during the implementation of a range of policies, some of which involve public hearings with varying formats. In 2011 it proposed a major change to such procedures used in the redistribution of Parliamentary constituency boundaries. Local Inquiries were deemed ‘not fit for purpose’ and eliminated, because they were lengthy and dominated by the political parties seeking electoral gain. This change was opposed in Parliament and an alternative procedure introduced involving Public Hearings which were to be shorter and less conflictual than the Local Inquiries they replaced. The Hearings for the first round of redistributions under the new procedure have now been held. This article assesses whether they were any ‘fitter for purpose’; there was very little participation by the general public and, as before, the proceedings were dominated by the political parties. 相似文献

While some of the future impacts of global environmental change such as some aspects of climate change can be projected and prepared for in advance, other effects are likely to surface as surprises – that is situations in which the behaviour in a system, or across systems, differs qualitatively from expectations. Here we analyse a set of institutional and political leadership challenges posed by ‘cascading’ ecological crises: abrupt ecological changes that propagate into societal crises that move through systems and spatial scales. We illustrate their underlying social and ecological drivers, and a range of institutional and political leadership challenges, which have been insufficiently elaborated by either crisis management researchers or institutional scholars. We conclude that even though these sorts of crises have parallels to other contingencies, there are a number of major differences resulting from the combination of a lack of early warnings, abrupt ecological change, and the mismatch between decision‐making capabilities and the cross‐scale dynamics of social‐ecological change. 相似文献
