Although concern with white‐collar crime has grown considerably in recent years, little research has been undertaken on the workplace misconduct of juveniles. This omission is noteworthy because of the extensive involvement of youths in the labor market. Accordingly, based on a sample of high school seniors, we explored the determinants of youths' occupational delinquency. The analysis revealed that work‐related delinquency is affected both by underlying criminal propensities and by contact with delinquent coworkers on the job. It also appears that delinquent youths are selected into negative work environments in which they come into contact with fellow delinquents—an interaction effect that amplifies their occupational delinquency. Finally, the data suggest that associating with delinquent coworkers affects misbehavior not only within, but also outside the workplace. In this article, the non‐unanimous decisions of the Portuguese and Spanish Constitutional Tribunals for the periods 1989–2009 and 2000–2009 are analysed. It is shown that judicial dissent can be predicted moderately well on the basis of judicial ideal points along a single dimension. This dimension is equivalent to the left–right cleavage in both Portugal and Spain. The characteristics of the recovered dimension are demonstrated by analysing both the properties of the cases and the properties of the justices who decided them. 相似文献

Political advisers are an established third element in a number of Westminster‐styled jurisdictions, as they are in New Zealand’s institution of executive government. In this paper we report the initial findings of a research project focusing on the role and accountabilities of ministerial advisers in New Zealand. We locate these findings in the context of a growing body of international and comparative research on the role and accountabilities of non civil‐ or public‐service advisers within political executives and comment on the extent to which the findings affirm or refute the view that the ‘third element’ constitutes a threat to the continued application of Westminster principles and practices in New Zealand’s system of government – once described as more Westminster than Westminster. In doing so, we highlight deficiencies in standard conceptions of politicization and argue that there is a need to more clearly differentiate between its procedural and substantive dimensions. 相似文献

Children's lawyers too often view themselves as standing in opposition to parents in dependency proceedings. In this article, the authors argue that child advocates do a disservice to their clients by not using their considerable skills, role advantages, and moral authority to actively help parents. Noting that areas of common ground far exceed those places where the children's bar and the parents' bar might part company, the authors contend that children's lawyers have an obligation to actively fight for parents' rights. In particular, spending time early in a case to ensure that appropriate reunification services are being offered is well worth the investment, as it redounds to the benefit of all parties. Several concrete practice tips are offered regarding how children's lawyers can better serve their clients by regularly advocating for parents. 相似文献

This symposium, ‘Conceptualizing New Governance Arrangements', takes up the challenge of refining governance theory to better integrate work in several disciplines, most notably politics, public administration and law. To this end, we argue for a theoretical framework that profiles three key dimensions of governance: institutional, political and regulatory. This framework, in our view, offers new insights into the nature and operation of various governance arrangements, and offers the potential to assess and measure change within such arrangements over time. After describing our methodology for selecting and analysing the case studies profiled in the symposium, we introduce each of the articles that apply our three‐dimensional governance framework. These articles employ the framework to consider a variety of contemporary governance scenarios that vary widely by sector (environmental, climate change, forestry and education policy) and level of analysis (sub‐national, national, and bi‐national). 相似文献

This article examines migrants' self‐reported experiences via application of human well‐being approaches to deepen exploration of the barriers that migrants themselves identify in achieving their goals and getting their needs met. A focus on the construction of human well‐being can potentially provide a more holistic approach to debates on international migration. Discussions have focused on labour market integration, paying less emphasis to migrants as social agents and the psychosocial elements that they consider important for achieving human well‐being. A discussion of how politics is done in Britain, and how it could be done differently. It explores the relationship between culture and structure in politics, and between strong government and effective accountability. The argument is that the concentration on structures can lead to a neglect of the importance of political culture. It suggests that there are three democratic levels, and that Britain does better on one than on the others; and identifies a range of democratic issues to be tackled. It concludes by suggesting that even without major instrumental changes there are cultural changes that would make a difference to how politics is done in Britain. 相似文献
