Group litigation is becoming commonplace. Rules of standing have been relaxed to allow groups to bring representative actions on behalf of their members or to act 'in the public interest'. Groups increasingly intervene in actions between third parties, presenting amicus briefs. This article traces the origins of group action in courts and speculates on the possible effects of changes which blur traditional distinctions between legal and political process, concluding that the legal process must be kept broadly within traditional boundaries, if the qualities of independence, rationality and finality for which it is valued are to be maintained.  相似文献

There is currently much interest in the question whether a globaladministrative law is coming into being and, if so, whetherthis is desirable or otherwise. This paper addresses the questionof principles for a global administrative law. It considersfour potential sources and their suitability as a foundationfor a global administrative law system: first, the largely proceduralprinciples that have emerged in national administrative lawsystems, notably the principle of legality and due process principles(Section 3); second, the set of rule of law values, promotedby proponents of free trade and economic liberalism (Section4); third, the good governance values, and more particularlytransparency, participation and accountability, promoted bythe World Bank and International Monetary Fund (Section 5);and finally, human rights values (Section 6). The paper endson a sceptical note, concluding that a universal set of administrativelaw principles is difficult to identify and not especially desirable.First, administrative law is primarily a Western construct,protective of Western interests. It may impact unfavourablyon developing economies. Secondly, the evolution of global administrativelaw in adjudicative forums is leading to an undesirable ‘juridificationof the political process’. In an investigation of sex differences in adaptation to college, real and ideal self-concept and symptoms of depression were studied longitudinally in a sample of 287 students. Survey data were collected at a summer orientation and one semester into freshman year. No sex differences in self-concept were found before college, but males' real self-concept became more positive over the transition. Females were more depressed than males at both times, although depressive symptom scores increased in both sexes. Real self-concept scores were negatively correlated with depressive symptoms in both sexes at both times, while the discrepancy between real and ideal self-concepts was positively correlated with depressive symptoms among females before college and in both sexes midway through freshman year. A one-year follow-up revealed that females' real self-concept scores increased to match those of males by mid-sophomore year. These sex differences are discussed in relation to psychological development during adolescence.  相似文献

This study investigates the effects of federal policy and budgetchanges during the Reagan years as well as the revenue strategiesof governmental and private, nonprofit agencies in Stamford,Connecticut. Systematic examination of agency budgets and interviewswith agency directors in 1982 found widespread anxiety aboutpossible revenue decline, but few departures from traditionalrevenue strategies. In Stamford, federal changes produced revenueproblems for only a few agencies, most of which went about "businessas usual" and did not experience a budget crisis. Despite its deep theoretical roots, the idea that voters reward or punish incumbents in national elections for trends in their personal financial circumstances has not fared well when subjected to empirical test. This paper poses an experimental test of the leading explanations for the surprisingly weak showing of pocketbook influences on vote choice. According to certain of these explanations, the answer lies in distinguishing between sociotropic and self-interested economic voting, or between retrospective and prospective economic voting, or between perceptions of economic trends in general and perceptions of the electorally relevant component of these trends. However, expectations based on these explanations are generally not borne out in the laboratory setting. Consistent with the observed pattern of effects, however, is the idea that pocketbook voting displays little independent impact because economic perceptions and attributions are epiphenomena—strongly biased by the voter's preexisting political commitments.  相似文献

Beliefs about intelligence can vary from the view that it is stable to the view that it is unstable. Third through eleventh grade academically talented students (n =153) rated their beliefs on the stability of intelligence using a 6-point Likert scale. They also rated themselves on similar scales for how smart and hardworking they thought they were, and how much they liked hard tasks. Students' views of the stability of intelligence paralleled a normal distribution, with almost one-half having borderline views that can be easily modified to match environmental demands. Approximately 9% of these talented students were at risk for underachievement based on their self-perceptions of relatively low ability and the belief that intelligence is stable. High school students believed intelligence was more stable than elementary students and females described themselves as being harder workers than males. Findings may account for the differing academic experiences and performance of academically talented students over time.Received Ph.D. in Psychology from University of Maryland Baltimore County.
