云南边疆民族地区毒品犯罪主体结构与演变

云南是我国毒品重灾区，每年抓获的毒品犯罪嫌疑人呈不断上升之势。毒品犯罪主体不仅数量剧增而且向社会全方位扩散，表现出多元化和多源化的特点：从职业身份来看，农民和无业人员占绝大比例；从籍贯来看，云南省籍贩毒逐渐减少，而外省、外国籍毒贩增多，二者此消彼长；特殊人群贩毒突出；从社会分层看，大部分是‘吗仔”。

2010年11月28日,海地举行总统选举第一轮投票,民主进步联盟候选人、前“第一夫人”米朗德·马加尼得票最高,执政党候选人汝德·塞莱斯廷和流行歌手迈克尔·马尔泰利（MichelMaaelly）得票分列二三位。结果公布后,海地发生大规模骚乱,抗议选举中存在舞弊行为。原计划于今年1月举行的第二轮投票被迫推迟。经过联合国、美洲国家组织及美国政府等出面调停,塞莱斯廷主动退出竞选。今年3月20日,总统选举举行第二轮投票,     

The Status and Characteristics of Couple Violence in China

A couple’s relationship is very important to marital well-being as well as the harmony of family and society. Violent behaviors in marriage have bad effects on people’s physical and mental health and cause large social burdens. In this study, we investigated 194 couples in Beijing to explore the status and characteristics of couple violence from three aspects by using Revised Conflict Tactics Scale (CTS2). We conclude that: (1) Couple violence is universal, although the frequency is not so high. Prevalence and frequency of psychological violence are higher than physical and sexual violence; rate of wives’ victimization is significantly higher than that of husbands; frequency of the perpetration of sexual violence by husbands is significantly higher than that by wives. (2) There is concurrence of different types of couple violence. Specifically, physical and sexual violence are usually accompanied by psychological violence; however, psychological violence exists independently. (3) Couple violence is often bidirectional, especially in psychological violence. (4) Marital length is negatively correlated to wives’ perpetration of physical violence and their victimization of sexual violence.     

论医疗损害责任抗辩事由及其法律完善

《中华人民共和国侵权责任法》第60条规定了医疗损害责任的抗辩事由,但法律规定不够完善,难以完全应对实践需要。因此,需要对第60条进行法律解释,并需丰富医疗损害责任抗辩事由体系,增加规定无因管理、医疗特权、意外事件、自甘冒险、损益相抵和并发症等抗辩事由。此外,结合我国医疗卫生事业体制和医学科学特点以及比较法的经验,应适当限制医疗损害责任赔偿。     

新形势下经济犯罪的特点分析及对策

随着中国改革开放的深入和经济的不断发展,经济犯罪在原有犯罪形式的基础上,又有了新的特点,呈现出信息化、智能化和多样化,同时也给经侦工作带来了新的挑战。本文在分析了新形势下经济犯罪的特点后,针对经侦工作的新挑战提出了相应对策,希望对经侦工作的理论研究有所帮助。     

DIVORCE IN THE NURSERY: ON INFANTS AND OVERNIGHT CARE

Infants, parental separation, custody, and overnight care: a vexed combination of issues and needs that has long perplexed the family law field. Carol George and Judith Solomon have conducted the only published observational study of infant attachment in light of postseparation overnight care arrangements. Here they revisit that study and bring more than three decades of experience to bear on questions concerning very young children implicated in family law disputes. Currently a professor of psychology at Mills College, California, George is an author and coauthor of several notable attachment measures and has over 50 research publications in the area of attachment. Judith Solomon is both a clinical psychologist and a researcher in the attachment field, specializing in the study of early attachment relationships and representations, most recently in the Department of Pediatrics, Bridgeport Hospital. George and Solomon are associate editors of the journal, Attachment and Human Development, reviewers on multiple developmental journals, and both consult and teach internationally.     

公司法人人格否认制度的完善

公司法人人格否认制度的确立可以有效的控制股东的投资风险,保证交易安全,保护公司债权人利益和社会公共利益,维护经济秩序,促进社会主义市场经济健康发展,但公司法对该制度适用的情形没有具体的规定,造成实践中可操作性差。文章分析了该制度适用的情形,并提出了完善相关立法的建议。     

劳动力转移对农业经营体制市场化影响研究

随着我国农业人口向城市持续转移,农地流转也不断增加。这两个农村重要经济条件的变化,对我国农业经营体制有重要影响,推动农业经营体制向市场化不断转变。重点分析了劳动力转移对形成于1980年代的农业经营体制的影响机制。     

R＆D活动的产出效率分析——基于广东省的个案研究

R＆D是科技活动的核心。利用第二次全国R＆D资源数据对广东省R＆D活动的产出效率进行研究的结果表明,2001—2009年广东省R＆D活动的科技产出和经济产出规模快速扩大,质量不断提高,但是增长的起伏较大。数据包络分析（DEA）显示,广东省R＆D产出的综合效率较高,但是规模效率不佳,R＆D人员投入存在冗余,R＆D活动的产出不足率较高,目前R＆D产出已处于规模报酬递减阶段。由此得到的启示是,广东省要提升R＆D科技产出和经济产出的稳定性,优化R＆D资源配置。
