The Public Trust as an Evolutionary Doctrine: How the Trust can be Used to Allege an Injury Under Standing

The public trust doctrine provides protection of public access to resources, such as navigable waterways, protected under the public trust. The doctrine has evolved over time to protect natural resources such as tidelands, submerged waterbeds, wildlife, and climate change. Juliana v. United States is a groundbreaking trust case that moves the application of the trust to the management of climate-change regimes. Although the doctrine has been criticized as a façade, forestalling real recourse for change, it can be used to show standing for current and future generations. Accordingly, Juliana outlines how this doctrine is not just evolutionary it is also revolutionary.     

A Framework for Integrating External Information into New Product Development: Lessons from the Medical Technology Industry

Only the best manufacturers will remain competitive in today's challenging environment. Any manager involved with developing new products knows the excitement, complexity, and risk of this unpredictable undertaking. Based upon findings from four world class manufacturers of medical imaging technology in Japan and the United States, this article presents a new organizing framework for integrating external information into the NPD process. The findings are particularly timely in an era when manufacturers are vulnerable to intense global competition. The article concludes with several implications for managers involved in the new product development process.     

Rethinking accountability in complex and horizontal network delivery systems

This paper revisits the conventional notion of accountability rooted in bureaucratic and hierarchical structures of government and advances an alternative conceptualization more useful for analyzing complex horizontal network delivery systems. Although such systems are increasingly prevalent, they often exacerbate the problem of accountability in the public sector. By examining regional economic development policy implementation in Manitoba, this article illustrates the prospects and challenges of adapting conventional constructs of accountability to horizontal network delivery systems.

‘Ek sê, heita!’: Kwaito and the construction of community

Abstract

Kwaito can be described as the new music of the new South Africa. Since its emergence over a decade ago, kwaito still blasts from minibus taxis, on the new urban commercial stations formed after media liberalisation, and on street corners from Cape Town to Johannesburg. Kwaito is young, vibrant and decidedly black. This is hardly surprising in a context where music, like everything else, is a highly racialised terrain. This article describes the emergence of kwaito, and explores community radio station, Bush Radio's, broadcasts of kwaito music, looking at how these broadcasts create a sense of community. First, kwaito's emergence within the context of South Africa's mainstream cultural industries is articulated. Then kwaito music is explored as a signifier of black identity. This article is located within a cultural studies framework, which approaches musical genres as cultural texts capable of generating multiple meanings (Grossberg, 1993).
