This paper explores the visual construction and representation of co-accused women offenders in court drawings. It utilises three case studies of female co-defendants who appeared in the England and Wales court system between 2003 and 2013. In doing so this paper falls into three parts. The first part considers the emergence of the sub-discipline, visual criminology and examines what is known about the visual representation of female offenders. The second part presents the findings of an empirical investigation, which involved engaging in a critical, reflexive visual analysis of a selection of court drawings of three female co-offenders. The third part discusses the ways in which the court artists' interpretation, the conventions of court sketching, and motifs of female offenders as secondary actors, drew on existing myths and prejudices by representing the women as listening, remorseless ‘others’.  相似文献

SPERM ON ICE     
Freezing technologies and extraction techniques make posthumous reproduction possible. This article discusses the bioethical and legal debates that surround the possession and use of dead men's sperm as they unfold in three select cases in Denmark and Australia. In the analysis we use feminist perspectives on reproduction to argue that the debates frame posthumous reproduction in light of four discursive configurations: The ‘child’, the ‘father’, the ‘widow’, and the ‘necrophile’. Whereas the performance of responsibility and maturity is key in the production of the ‘good’ widow in the Australian legal cases, the monstrous figure of the necrophile takes on a more prominent place in the Danish bioethical material. The legal and bioethical debates jointly, however, resurrect the nuclear, patriarchal family, while they also tend to re-naturalise heterosexed, romantic reproductive desire.  相似文献

In Lawrence v Gallagher, the issue as to what constitutes an equitable division of assets in the event of civil partnership dissolution arose for the first time. It had been hoped that the case would mark a break away from the heavy reliance upon heteronormativity that had been characteristic of the previous ancillary relief case law. However, it is argued here that what we see within the judgment is the Court of Appeal presenting the problem (and, so, the parties) in Lawrence so as to ‘fit’ within the pre-existing framework. Even at this early stage, it seems that legal actors are approaching civil partnerships on the basis of gendered assumptions and expectations. There is a need to raise awareness of this inability to get past ideas about heteronormativity, and to highlight their possible incompatibility with the lives of lesbian and gay couples, before their radical potential is lost.  相似文献

This paper focuses on the framing strategies lobbyists apply to influence public policy in a case on nuclear emission data in Switzerland. Framing analysis is at the heart of communication science and has been applied in lobbying settings, but framing theory has not yet been fine‐tuned to the specificities of public affairs research. This qualitative case study gives insights into the dominant frames seven actors ranging from corporations to nongovernmental organizations to public institutions employ to defend a legal court case in the nuclear power industry. The results of the document analysis and the interviews show that frames travel among diverse actors and only some are picked up by the courts, at times stating a position opposite to the one initially intended by the frame sponsor. A public affairs‐specific integrated process model of framing is presented that views the media in the role of a moderator in the framing process and pronounces the lobbying organizations' strategic goals, the different stakeholders as target audiences, and the outcomes of the public affairs process.  相似文献
