This note shows how Kornai's concept of the soft budget constraint can be decomposed into separate elements of technical inefficiency and relative price distortion. The distinction between r-budget softness and m-budget softness introduced by Gomulka is shown to correspond to the equivalent and compensating variation measures of efficiency loss. It is also argued that budget softness should be viewed as the outcome of a rent-seeking process in which a firm's action in the control sphere incurs an opportunity cost in the real sphere. Adopting such a perspective leads to a re-definition of the resource loss associated with budget softness and results in much higher estimates of the social costs of soft budgets than those proposed in the existing literature.  相似文献

This paper charts some major differences in the way in which evidence of the defendant's character is treated in France when compared with practice in England and Wales. Such evidence is more pervasive and visible (especially in the most serious cases) and its relevance is more broadly defined. Further, its presentation is shaped by a developed and positive conception of the French citizen. In part, these differences may be explained by differences in procedural tradition: the unitary trial structure in France, the dominance of fact—finding by the professional judiciary, and the rejection of general exclusionary rules of evidence. But a full explanation requires French legal culture to be understood in the context of French political culture. This reveals a very different conception of relations between state and citizen to that of Anglo-Saxon liberalism. As a result the legitimacy of trial is seen in terms of the rehabilitation of the accused as a citizen of the state rather than simply the punishment of a particular infraction.  相似文献

The purpose of this article is to describe and evaluate the public consultation exercises mounted by the Local Government Commission for England under its successive Chairmen, Sir John Banham and Sir David Cooksey. The Commission was evidently proud of this aspect of its work, emphasizing repeatedly its unprecedented nature: in itself an unremarkable claim in the context of British local government structural reviews. This article suggests that, in terms of quality and value for money, as opposed to sheer scale, the consultation programme - and particularly the three principal tranches of MORI residential surveys - was less laudable. The article examines each of these surveys: the stage one community identity polls, which might have contributed to the government's intended 'community index', had the latter not previously been rejected by the Commission; the stage three option consultation surveys, the Banham Commission's instrument for the hybridization of English local government, which prompted accusations of policymaking by opinion poll; and the stage three 're-review' surveys for the Cooksey Commission, which had already indicated its disinclination to accord local public opinion any special weighting in its deliberations. The article attempts to summarize, in two key tables, both the results and the impact of the Commission's public consultations, and in doing so to trace the progress of the review from an initially proposed 99 new unitary authorities, down to 50, then 38, and back up to the final total of 46.  相似文献

Manufacturing extension centers have helped small manufacturers improve performance on the shop floor and thereby reduce costs. This article presents a case study of a metal working firm that was able to increase productivity and profits by instituting measures recommended by a field agent working for the Florida Manufacturing Technology Center (FMTC). As a result of services provided, the company was able to boost manufacturing throughput and increase production efficiencies. Using a simulation model, the article explores how small changes in manufacturing performance can result in significant cost reduction. It then discusses the consequences of alternative strategies designed to enhance the value of goods sold, rather than lower the costs of production. It concludes by arguing that manufacturing extension centers should help companies become more distinctive as well as more efficient.  相似文献

A version of the stability of punishment hypothesis is used to illustrate the concept of cointegration and its relationship to error correction models. The hypothesis is then tested and rejected using data from England and Wales. Finally, a dynamic time-series model relating imprisonment to convictions, crime, and Unemployment is developed and tested.The empirical results in this work are based upon those originally prepared for a paper to be given by the author and Steve Box at the meeting of the American Society of Criminology held in Montreal in November 1987. Steve Box died in September 1987 before it could be completed.The paper is dedicated to his memory and it is hoped that he would have approved its content, if not, perhaps, the dryness of its form.  相似文献

Artificial intelligence (AI), machine learning (ML), affective computing, and big‐data techniques are improving the ways that humans negotiate and learn to negotiate. These technologies, long deployed in industry and academic research, are now being adopted for educational use. We describe several systems that help human negotiators evaluate and learn from role‐play simulations as well as applications that help human instructors teach negotiators at the individual, team, and organizational levels. AI can enable the personalization of negotiation instruction, taking into consideration factors such as culture and bias. These tools will enable improvements not only in the teaching of negotiation, but also in teaching humans how to program and collaborate with technology‐based negotiation systems, including avatars and computer‐controlled negotiation agents. These advances will provide theoretical and practical insights, require serious consideration of ethical issues, and revolutionize the way we practice and teach negotiation.  相似文献
