The Inevitability and Indeterminacy of Game‐Theoretic Accounts of Legal Order

How is legal order possible? Why do people comply with law when it prevents them from doing what they think best? Two important books show how these questions can—and from some methodological perspectives must—be answered in the form of game‐theoretic accounts that show how legal compliance can be compatible with the broad self‐interest of officials and citizens. Unfortunately, however, these books also serve to demonstrate that game‐theoretic accounts along these lines lack the resources to explain how real‐world legal systems emerge and evolve or the various institutional shapes these systems take. The fundamental limitation of game theory, in this context and more generally, is its inability to predict or explain the size and shape of cooperative equilibria.     

A Review of Alcohol‐Impaired Driving: The Role of Blood Alcohol Concentration and Complexity of the Driving Task

The operation of a motor vehicle requires the integrity of sensory, motor, and intellectual faculties. Impairment of these faculties following the consumption of alcohol has been studied extensively through laboratory, closed‐course and on‐road driving, and epidemiological studies. The scientific literature was reviewed critically, with a focus on low‐to‐moderate blood alcohol concentrations (BAC ≤ 0.100%), to identify the most reliable determinants of alcohol‐impaired driving. Variables such as age, gender, driving skill, and tolerance were shown to have limited impact on impairment. It was concluded the most relevant variables are BAC and complexity of the driving task. The scientific literature provides a high degree of confidence to support the conclusion that a BAC of 0.050% impairs faculties required in the operation of a motor vehicle. Whether impairment is apparent depends upon the complexity of the driving task, which applies to both study design and actual driving.     

Location and other correlates of campus crime

Crime and security are major issues on a number of college campuses in the United States, yet little criminology research has been aimed at the campus setting. This article explores whixh aspects of the campus profile seem to contribute, or at least relate, to high levels of campus crime. A regression of crime rates on dimensions of the campus profile uncovered a number of correlates (specifically, measures of campus size and scholastic quality) in our sample of 222 colleges and universities. Somewhat surprisingly, the location of a campus—be it in an urban or a rural setting—had no impact on the level of its crime problem, though a slight influence on crime mix (proportion of crimes that are violent) was found.     

Criminology and victimology of rape in context with war-like conflicts using the example of the former Yugoslavia and Rwanda

The topic of this article is sexual violence in context with war-like conflicts in the former Yugoslavia and Rwanda. The fundamental categories of sexual violence in war-like conflicts are described. The authors discuss the types of sexual violence as defined in the report of the UN Commission of Experts on the war-like conflicts in the former Yugoslavia. Four criminal trials were evaluated: three held before the International Criminal Tribunal for the Former Yugoslavia (ICTY) in The Hague/Netherlands and one before the International Criminal Tribunal for Rwanda (ICTR) in Arusha/Tansania. The defendants were found guilty of torture, crime against humanity and genocide. Potential procedures with respect to similar crimes in current or prospective conflicts are discussed. An alternative may be the assignment of medical personnel (for example of the German Federal Armed Forces). Finally, the post-war cooperation between the Institute of Legal Medicine at the University Medical Centre of Hamburg-Eppendorf as well as the medical and government institutions in Rwanda is presented, which has been going on since 2005.     

Ethics and the unintended consequences of social research: A perspective from the sociology of science

It is argued that successful social science requires the development of a social ethic or sense of research responsibility. An examination of impediments to ethical reflection in sociology suggests that an individualistic orientation is ineffective in coping with the unintended consequences of social research. Such consequences can be particularly harmful in the sociology of science where policy research and governmental support for its production often entails an indiscriminate advocacy of knowledge. Such advocacy raises anew questions of the power of scientific knowledge, the definition of client-professional relationships, and the collection of data which may not only violate the intent of individuals and groups supplying information, but may undermine the credibility of sociology itself.An early version of this paper was presented at the Sixth Annual Alpha Kappa Delta Sociological Research Symposium, Richmond, Virginia, February 19–21, 1976.     

Building Capacity in Election Administration: Local Responses to Complexity and Interdependence

Public administration research has identified networks, professionalization, and collaboration with community interests as potential principles by which public organizations can enhance their capacity and effectiveness. This article explores the implementation of these principles by election administrators at the local level, where their ability to conduct elections is the subject of current scrutiny. Findings indicate that election administrators established networks, professional organizations, professionalization requirements and community collaborations prior to the passage of the Help America Vote Act of 2002. Findings also suggest that local election efforts may become more effective as a result of certain provisions of the act that promote centralization and information dissemination. Local election administrators may also continue to build capacity by applying these public administration principles.
