This paper responds in its first sections to a series of articles in which Rainer Schmalz-Bruns developed a concept of legitimate governance beyond the constitutional state, which he called 'deliberative supranationalism' and contrasted with what Jürgen Neyer and the present author had suggested under the same title. The Epilogue of the paper first comments on more recent critiques brought forward especially by contributors to this Special Issue of the ELJ and then on the programmatic rejection of comitology by the European Commission's White Paper on Governance in the EU. Our querelles allemandes were not specifically Teutonic: while Schmalz-Bruns presented his approach as a systematic elaboration of the theories of deliberative democracy, based, in particular, on recent contributions by Joshua Cohen, Michael Dorf, and Charles Sabel, Jürgen Neyer and I had offered an interpretation of institutional innovations and decision-making practices as observed in the European market-building project. This discussion has had precursors and follow-ups in various contexts, among both lawyers and political scientists. This essay should hence be understood as a contribution to an ongoing debate. 相似文献

The term ‘public affairs’ has now become a much‐discussed topic in continental Europe's political and economic circles, including Germany and Austria. The problem is that few people really understand just what the term means. Many people have the impression that ‘public affairs’ is another way of describing lobbying. Others perceive it as classic public relations. In Europe many decision makers of the business world lack the specific knowledge of policy making; however, until now just a few such executives have taken advantage of the real opportunities opened up by using the services of professional public affairs consulting. Communications companies in Europe are now offering public affairs consulting as part of their services, with increasing success. A Conditional Defense of Plurality Rule: Generalizing May's Theorem in a Restricted Informational Environment 总被引:2,自引:0,他引:2
May's theorem famously shows that, in social decisions between two options, simple majority rule uniquely satisfies four appealing conditions. Although this result is often cited in support of majority rule, it has never been extended beyond decisions based on pairwise comparisons of options. We generalize May's theorem to many-option decisions where voters each cast one vote. Surprisingly, plurality rule uniquely satisfies May's conditions. This suggests a conditional defense of plurality rule: If a society's balloting procedure collects only a single vote from each voter, then plurality rule is the uniquely compelling electoral procedure. To illustrate the conditional nature of this claim, we also identify a richer informational environment in which approval voting, not plurality rule, is supported by a May-style argument. 相似文献

Playing children discovered several teeth close to the wall surrounding a village church. A subsequent police search yielded further teeth, three neurocranial fragments, a metacarpal bone and the fragment of a long tubular bone. The circumstances along with the results of the investigation and the morphological findings suggested historical bones from a former graveyard. However, a large fragment of bone shaft from a long bone could not definitely be classified as being of human origin. The tibia of a deer was amongst the possibilities considered. Comparative tests run at the Institute of Veterinary Anatomy of the University of Giessen in addition to histological examinations, however, ultimately established the human specificity. Interindividual variability and decomoositional changes were determined as causes for the conspicuous macroscopic and microscopic findings for the tibia fragment. The White Paper suggests important reforms that will reduce the likelihood of false confessions resulting from police interrogation.
The research underlying these suggested reforms has yielded significant advances in our understanding of factors associated
with false confessions. As we move forward, we encourage the development of empirically based approaches that provide a viable
alternative to current practice. In doing so, we suggest that researchers pursue a positive psychological approach that involves
partnering with practitioners to systematically develop interrogative methods that are shown to be more diagnostic. By taking
such an approach, we believe that the recommendations offered in the current White Paper can be supplemented by methods that

Among them we can identify water shortage, desertification, industrial and urban air pollution, acid rain, and extreme weather patterns. China is already a major polluter and its growth focus as well as the rapid urbanization process we can observe will further increase the pressure on the environment.
