In this article the current political debates at the World Intellectual Property Organisation (WIPO) relating to the proposed “development agenda” are set out and contextualised. Central to the proposal for the WIPO Development Agenda is the need to make the link to the United Nations (of which the WIPO is a Specialised Agency) actually mean something. Thus, at the centre of the WIPO Development Agenda is an engagement with the hitherto accepted mission of the organisation to “promote” intellectual property rights (IPRs). The article discusses the main components of the WIPO Development Agenda and the discussion to date regarding their adoption and modification by the WIPO.  相似文献

When Hurricane Katrina made landfall on the Mississippi Gulf Coast in August 2005, it immediately overwhelmed the abilities of local and state emergency management officials to respond to the ensuing disaster. Although the U.S. Coast Guard and some military units were on scene shortly after the passage of the storm, there seemed to be interminable delays before the military forces began to arrive in numbers to both provide humanitarian relief and secure the affected areas. This article analyzes the response of the National Guard, active-duty military, and Coast Guard forces through the lens of coordination. We find evidence of the successful use of both traditional hierarchical and network-based coordination; we also find support for Donald Kettl's idea of "contingent coordination."  相似文献

With the UK set to leave the EU, the Common Fisheries Policy (CFP) will no longer apply and an alternative legislative framework will need to be put in place, simultaneously navigating the devolved settlement. However, aspects of fisheries management fall under the area of international negotiation which is reserved to the UK government. Disagreements between the UK and Scottish governments over where the line between devolved and reserved lies in this matter has led to difficulties in formulating a post‐Brexit fisheries framework. This dispute has exposed weaknesses in relations between the two governments.  相似文献

Scholars have long understood that structuring internal work processes into more hierarchical or team‐based arrangements has consequences for organizational outputs. Building on this insight, this research examines the relationship between how agencies organize their rulemaking routines and the resulting rules. Tracking the job functions of rule contacts for economically significant rules proposed over a four‐year period, the analysis demonstrates that expanding the breadth of personnel types closely involved in a rulemaking is associated with a reduction in the time it takes to promulgate the rule. However, increasing the pace at which rules are finalized is not without cost, as those completed faster appear more likely to be overturned when challenged in court. The article not only adds another dimension to empirical scholarship studying rulemaking, which has largely focused on how forces originating outside the agency affect rules, but also suggests the importance of considering competing priorities in designing rulemaking processes.  相似文献

This paper examines the fiscal impacts of urban development patterns in the United States. Previous studies have indicated that it is costly to provide public services in areas with low‐density, spatially expansive development, leading to higher per capita expenditures. However, theory would suggest alternate outcomes. This paper examines this question using a panel dataset of U.S. urban county areas and a specification allowing for potential nonlinearity between development patterns and per capita expenditures. Estimates indicate that the spatial extent of development is the most important factor in expenditures; it is less costly to provide public services when development is more compact. Higher density increases per capita expenditures; however, the effects are small.  相似文献

Addressing climate change requires consideration of mitigation and adaptation opportunities at multiple spatial scales. This is particularly true in the built environment, defined here to include individual buildings, neighborhoods, and the spaces between. The current U.S. political environment portends fewer resources and coordinating services for mitigation and adaptation at the federal level, however, reinforcing the relevance and necessity of actions at subnational levels. In this study, we evaluate the applicability of a polycentric model of governance to the implementation of mitigation and adaptation practices, as well as the presence of polycentric systems in the built environment. We assemble a database of practices with the potential to achieve both mitigation and adaptation objectives, as well as those that may be cross‐purposed or that may achieve one but not the other. We review practices to gauge the applicability of a polycentric model of governance to mitigation and adaptation practices in the built environment, and examine the attributes of three existing adaptation and/or mitigation programs to assess the extent to which they exhibit polycentric attributes. We conclude with recommendations for a broader research agenda, including efforts to develop more in‐depth examinations into individual programs and comparative analysis of performances of different governance attributes.  相似文献
