Non-recent child sexual abuse (CSA) and child sexual exploitation (CSE) have received recent attention. Victims often do not report their ordeal at the time the incident occurred, and it is increasingly common for agencies to refer concerns to the police years, or decades, after the event. The combination of the non-recent nature of the offence, the lack of engagement by the (potentially vulnerable) victim, and the huge resource burden of investigation make deciding whether to proceed with investigation complex and ethically challenging. Although there will always be a presumption in favor of investigation, for some cases the reasons against investigating will outweigh this presumption. We examine the considerations at stake in making a decision about whether to make contact with the victim and proceed with investigating a particular non-recent CSA case. Arguing for a “broad rights” approach, we identify considerations relating to (1) the victim, (2) criminal justice and crime prevention, (3) limited resources, and (4) legitimacy. We argue that, all other things being equal, non-recent and current investigations are equally worthy of investigation. We assess the implications of suspects being persons of public prominence. We outline a principled decision-making framework to aid investigators. The Oxford CSA Framework has the potential to reduce unnecessary demand on police resources. 相似文献

Our goal is to analyze the culture within the San Francisco law firm of Gladstein, Andersen and Leonard (circa 1945–1965). For this we utilize archival documents, FBI files, oral histories, and personal interviews. The law firm represented alleged subversives, including Harry Bridges the longtime president of the International Longshore and Warehouse Union. Thus, the law firm partners were stigmatized by the clients they represented and they all had lengthy FBI files. The partners all had working class backgrounds, one was an immigrant and two were Jewish. Clearly, religion and ethnicity were not litmus tests for participation in the firm, nor was educational pedigree. Gladstein and Leonard graduated from elite law schools while Andersen did his legal training at a night school. During the dark days of the Cold War various partners were threatened, shot and jailed for merely engaging in their legal practice. Ironically, as the FBI blacklisted alleged subversives, these attorneys had more clients to defend. 相似文献

Abstract Political leadership at the local level has attracted growing attention in recent years in parallel with reforms of local government and of the municipal administration, as well as the debate on a shift from government to governance. Considering the power triangle of (i) the mayor, (ii) the municipal administration (executive officers) and (iii) the council, it is surprising that the latter has gained little interest so far. This article analyses how the roles of local councils as representative bodies are assessed by mayors from seventeen European countries and how differences in the perception of councils can be explained. Can differences be explained by institutional settings, the notion of the mayor towards the role of political parties or by the kind of interaction between the mayor and the council – or are specific local conditions and idiosyncratic personal factors crucial? 相似文献

Five aspects of local elections in Britain over a thirty year period are examined. First, the process of party politicisation has seen the growth of more three-party systems whilst in parts of the Celtic fringe electors may have a choice of at least four parties. The increase in party candidates has had an important impact on the second aspect considered, that of uncontested seats. In some areas, particularly in the larger towns and cities, lack of contestation has not been significant. In remaining areas the trend has been towards increased competition and challenge for council seats. The third aspect is electoral turnout, where a recent decline has prompted considerable debate. However, the benefit of a longitudinal study is to provide historical perspective. The data show fluctuations in turnout but no ‘golden age’ where participation rates were significantly higher than in the modern era. The fourth and fifth aspects are the distribution of votes and seats respectively. The two-party vote share has declined and voters appear more prepared to support minor party candidates. In turn this has contributed to a growth in the variety of party systems in local government. 相似文献

Cornwall Council is a new ‘unitary’ local authority which was created following the merger of six district councils and one county council on 1 April 2009. A questionnaire survey based on specific ‘dimensions’ of organisational culture was circulated to staff prior to the merger date. Overall, the results indicated a generally congruent culture characterised by a strong team spirit and commitment to the workplace. A number of differences were observed between the cultural orientations of the seven councils, but there was only weak evidence of differences between tiers of management or professional groupings. The study suggests that the new organisation will have to find ways of ‘unfreezing’ staff from their established ways of thinking and working before changes can be properly embedded. It is recommended that the organisational change process shifts from a top-down ‘planned’ approach to a more ‘emergent’ approach to facilitate learning and organisational development. 相似文献

The introduction of directly elected mayors into the landscape of English local politics has the potential to change the dynamics of local political leadership and the relationship between citizens and local government. The paper explores whether the conditions exist locally for such potential to be realised. It focuses on the reaction to the mayoral experiment of both mayors and the councillors that sit on mayoral authorities, as it is the reactions of the latter, as well as the actions of the former, that indicate the success or failure of mayoral governance. Performance measurement, targeting, reporting and managing of public services has spread across jurisdictions in recent years. The most usual stance adopted by governments in developing performance policies has been shaped by principal-agent theory and a hierarchy of principal-agent relationships from core executive to service delivery. Such notions have been challenged from several directions, both in theory and empirically. Writers on accountability and those analyzing the “audit explosion” and the growth of “regulation inside government” have pointed to the way in which multiple actors and accountabilities have grown. Drawing on these and other sources this article develops a “performance regimes” perspective that offers a heuristic analytical framework of the main groups of institutional actors who can (but do not always) attempt to shape or steer the performance of service delivery agencies. This paper uses the concepts of business model and financial ecosystem to analyse the relation between the US capital market and corporate business. Under a capital market double standard, from 1995 to 2000, new companies with digital prospects could recover their costs from the capital market; but, after the tech stock crash in 2000, all companies were required to generate profits from the product market. This encourages a blurring of old and new firm identities, because sectoral power is increasingly necessary to secure cost recovery. But this does not imply any return to business as usual when the financial ecosystem for new technology survives the crash and large-scale venture capital investment continues.
