The introduction, via the Local Government Act 2000, of political executives held to account by influential overview and scrutiny committees challenges fundamentally the traditional operations of the party group system. This paper uses evidence from a variety of sources (including the experience of Parliamentary select committees) to explore how councillors are managing the tensions between party group loyalty and the expectation surrounding the operation of scrutiny. Four models of party group behaviour are identified with the group acting as partner, arbitrator, filter and Leviathan respectively. These typologies are then used (together with research evidence) to interpret the circumstances in which effective scrutiny may be aided or hindered by party group dynamics. Three alternative scenarios, which illustrate the impact of different political dynamics on the effectiveness of scrutiny, are identified and explored. It is concluded that the success of the overview and scrutiny experiment is by no means assured and faced with the intransigent nature of most party group behaviour, the future of effective scrutiny hangs in the balance. 相似文献

State enforcement by state attorneys general (AGs) has become a major component of American antitrust law. Much has been written about state antitrust enforcement, but existing accounts of AG incentives and behavior are incomplete. As elected officials in forty‐three states, AGs must represent their constituents and, therefore, will be drawn to cases that maximize the level of settlement reward—cases with large, wealthy defendants. I hypothesize and find that state AGs represent their constituents along ideological lines, but this relationship is conditioned by case characteristics that involve the potential settlement reward. Moreover, incentives to participate are likely to be higher when there are clear violations of the law, as in price‐fixing cases, rather than in merger cases, where no wrongdoing has necessarily been established. The study adds to our understanding of antitrust law but also has implications for how distributive politics shapes political responsiveness to the electorate. 相似文献

Abstract Where analysis concludes that a context is characterised by high risk, as in thecase given HIV/AIDS in South Africa, individual choice and freedom are often negated, for instance, by social scientists when they resort to the statistical logic of large numbers. Ironically, given that knowledge and rationality are arguably related, the choice and freedom of the individual deemed not to have knowledge about a given issue, is questioned and soon negated. By focusing on the black people in South africa, as a key example, it is argued that such analyses and solutions deny the existential possibilities of the people. The aim of this article is to affirm an individual's possibilities. The situation of the individual who communicates is recalled to argue against approaches that variously seek to blame the individual. In the time of HIV/AIDS, ideas such as those of Søren Kiekegaard should be engaged to advance understanding of the limitations and possibilities of the individual who communicates. In the trasition from understanding to acting on information on HIV/AIDS, the individual has the freedom to choose. This is humbling for communication scientists and practioners who seek to prevent the further spread of HIV/AIDS. 相似文献
