With globalization and the rise of information and communications technology (ICT), the protection of intellectual protection in software and indeed foreign copyright has never been more paramount. The absence of statutory provisions in Nigeria’s main copyright legislation specifically protecting the intellectual protection in software has not helped. This article examines the Court of Appeal’s recent decision dealing with the protection of copyright in Microsoft’s software. The author is of the considered view that the approach adopted by the courts in the case is not in the overall interest of encouraging foreign ICT companies and the protection of foreign copyrights in Nigeria.  相似文献

Since the mid‐1990s, formal scientific risk management has been codified at all levels of food safety governance in affluent states: firm‐level standards, national regulation, and international law. Developing countries' access to affluent importers and power in international standard‐setting fora now hinges on their scientific capacity. This article explores the consequences of these developments in India, which moved quickly from resistance to acquiescence, and then later to mobilization around narratives of scientific risk management's local benefits. The case suggests a two‐stage model of scientization among developing countries: (1) coercive and competitive mechanisms drive adoption of science‐based governance models, and (2) as local actors mobilize to meet foreign demands, they attach their own interests and agendas to science‐based reforms. The outcome is a set of rational myths about the benefits of scientization. The article draws on content analysis of organizational, policy, and news documents and a small set of interviews with highly placed pubic officials and industry representatives.  相似文献

Unmet mental health need is a significant problem for adolescents. Although stigma is identified as a major barrier to the use of mental health services among youth, there is limited research on this topic. In-depth interviews (n=57) among a sample of 8th grade students in a suburban, mid-Atlantic community portray adolescent mental health attitudes and how these views are shaped. Satisfactory personal experiences with mental health services as well as accurate mental health knowledge contribute to positive mental health attitudes among teens. The anticipation of negative responses towards mental health care-seeking from family members, peers, and school staff are key factors in teens’ comfort and willingness to address mental health concerns. The research provides critical information on the factors that contribute to the development of stigma and emphasizes the need to address stigma in youth mental health education, programs, and treatment plans. Authors are affiliated with the Johns Hopkins Bloomberg School of Public Health, Department of Population and Family Health Sciences. Dr. Chandra has a background in adolescent health, and is particularly interested in improving the accessibility and appropriateness of youth mental health services and involving young people in the translation of research into practice. We examine the factors that improve the candidates’ likelihood of winning an election by drawing on information from campaign resources used by candidates running in the 2002 French parliamentary election. The main effects that we wish to analyze are the candidates’ gender, political affiliation and possible incumbency. We find that the contributions the candidates received and their political affiliations determine their acceding to the second round of the elections. But surprisingly once they make it to the second round, the contributions cease to be relevant; only the candidates’ gender, incumbency and the actual spending rather than the contribution levels matter.  相似文献

We use economic theory to examine the intensity of fundamentalist sects in which leaders work to enhance their followers’ observance level. We model three stylized situations under which fundamentalist groups function, examining the intensity of observance in each. We find that, under reasonable conditions, rivalry among fundamentalists makes them more extreme.  相似文献

The events of 9/11 have influenced policy making in public administration. The Homeland Security Act of 2002, which created the Department of Homeland Security, contained language that empowered the secretary of homeland security and the director of the Office of Personnel Management to establish a personnel management system outside the normal provisions of the federal civil service. Why did civil service reform succeed as part of this legislation when previous attempts at large‐scale reform had failed? A case analysis of the enactment of civil service reform in the Homeland Security Act points to theories of policy emergence and certain models of presidential and congressional policy making. In this case, civil service reform became associated with national security instead of management reform. An assessment of the rhetorical arguments used to frame this policy image offers a powerful explanation for the adoption of the personnel management reforms in the Homeland Security Act. This case has implications for understanding how policy makers might approach future management reform agendas.  相似文献

Adolescent girls aged 12 through 16 years, identified as either educable mentally retarded, behaviorally disordered, learning disabled, or nonhandicapped, were rated by their teachers on the Behavior Problem Checklist. Analysis of these ratings revealed significant differences for pupil category, Behavior Problem Checklist dimension, and category-by-dimension interaction. Behaviorally disordered students showed a greater degree of maladjustment than the retarded and nonhandicapped students on all four checklist dimensions, and exceeded the learning disabled on three dimensions (not Personality Problem).
