Outside academia, John Rawls's theory of justice—justice as fairness—has had little impact. This article is part of a broader project to rectify this. I offer a distinctive, second‐best, argument for Rawls's difference principle. The difference principle requires that inequalities in income and wealth are justified only if they benefit society's least‐advantaged citizens. My paper argues that, slightly‐modified, the difference principle is an excellent principle of redress in light of the UK's continued failure to give all citizens fair career chances. I show how we might realize the difference principle at the level of policy through tax rate reductions or negative tax rates. I conclude that if you don't want to accept the second‐best argument for the difference principle you must get serious about giving all citizens fair career chances. As I suggest, this task is extremely difficult.  相似文献

This study assesses the relative impact of different lengths of imprisonment upon parole outcome, for narcotic law violotors, while holding other factors constant. Three alternative procedures for measuring association (r, ø and rt) were each used in parallel base expectancy analyses on the same data base. The study group consists of 929 narcotic law violators who were paroled in 50 jurisdictions. Parole performance ws derived after a twe-year follow-up period The 1968 parolees were used to develop offender risk ratings. These ratings were applied to 1969 parolees to determine whether they would be associated with parole outcome in a new sample. The three methods worked about the same for developing offender risk ratings. Once personal characteristics of offenders were taken into considemtion, the number of months served had no consistent relationship to parole outcome. This remained true for all three parallel techniques used.  相似文献

In the treatment of status offenders, the espousal of a medical therapeutic model has led to the development of diversion programs designed to offset a progressive career escalation from petty to serious delinquent acts. Using the offense histories of 1200 juveniles, transition probabilities were created to test for offense specialization and offense escalation. Controlling for age, sex, and race or ethnicity, the career transition configurations were reflective of homogeneous, number-independent Markov processes. The implications of these findings run counter to many popular assumptions of delinquency causation and treatment and challenge the basic tenets of many status offender programs.  相似文献

Albert Cohen's delinquency theory is vulnerable to demonstrations of similar qualities, as well as similar quantities, of delinquency between middle and working-class groups. In analyses of questionnaire data from a high school male population, no significant differences in incidence of delinquency emerge between classes. No significant differences obtain between classes of delinquents on items tapping the peer or subcultural dimensions Cohen considers particularly characteristic of working-class delinquency. The policies advanced by the Juvenile Justice and Delinquency Prevention Act, while generally viewed as a success, are seen by some as a failure that may even abet juveniles in the commission of crime. After tracing the evolution of federal juvenile justice legislation and examining arrest and treatment data, the authors confront the criticisms aimed at the Act, and find reason for considerable optimism. Nationwide, the number, proportion, and rate of juvenile arrests have fallen more than the juvenile population, and many states appear to have made substantial progress in improving the processing and treatment of juveniles. The authors conclude that the Act is a continuing source of federal leadership for state innovation.  相似文献

The burgeoning need for private police to complement the activities of public police has added a new dimension to issues of reliability and validity of official statistics. For purposes of this study. shoplifting data generated by the private police sector were gathered from matched pairs of retail stores. The findings showed significant differences between stores by age and gender. Partitioning of contingency tables to localize the association to a particular category produced no systematic conclusions between the matched pairs of stores or among the full range of sampled stores. Differential law enforcement exercised by an untrained and unregulated private police force calls into question the concept of justice and the guarantees of due process.  相似文献
