Industry Self-Regulation: An Institutional Perspective

Throughout the advanced countries of the world self-regulatory regimes are being introduced. This article suggests that, at least in some contexts, industry self-regulation can be an effective and efficient means of social control that has been largely ignored by economics (which has a focus on individual rather than group behavior) and prematurely discounted by mainstream regulatory theory. The article examines the strengths and to a lesser extent the weaknesses of industry self-regulation from five closely related yet distinct vantage points: mediating institutions; industrial morality; institutionalizing responsibility; institutions responding to external pressure; and the roles of the state and third parties.

Medieval Welsh Law and the Mid-Victorian Foreshore

In 1862 a text of medieval Welsh law, attributed to the tenth-century king Hywel Dda (Hywel the Good), was cited as part of the defence in a case, Attorney General v Jones, concerning disputed foreshore rights in Anglesey, north Wales. This article aims to explain why and how Welsh law, effectively abolished by the Acts of Union of 1536–43, was deployed as evidence in the case and how far this marked a readiness to accommodate the distinctive legal heritage of Wales within the framework of the nineteenth-century common law. As well as analysing the legal arguments presented, the article seeks to assess the broader significance of the case by setting it in the contexts of the Crown's increasingly vigorous claims to foreshores, the circumstances and attitudes of the real defendant, William Bulkeley Hughes, and antiquarian study of the medieval Welsh law-texts, including their use in previous mid-Victorian foreshore disputes.     

State Dilemmas in the Provision of Alternative Care for Children: Relative Efficacy of Public Sector and Independent Sector Foster Placements

The population of children around the world who require alternative care outside of the natural family is staggeringly large. This presents fundamental dilemmas and challenges for every nation. This article notes how the United Kingdom's (UK's) response has evolved from that of a non-interventionist state to one that claims an interest in “Every Child”. Attention is drawn to the way in which the State's “Third Way: What matters is what works” ideology has led to radical reform of public sector services and the widespread sub-contracting of alternative care for children to the independent sector.

The article presents rare data on the relative performance of children in public sector as opposed to costly independent foster care. Contrary to expectations the data reveal minimal differences between the two groups. The data offer no justification, on the grounds of efficacy, for the use of independent sector provision as opposed to public sector provision.
