我国生态环境公益诉讼发展之进路

生态环境公益诉讼是贯彻“绿水青山就是金山银山”生态环保理念的司法实践,为打好污染防治攻坚战、实现生态环境治理能力现代化、健全公平正义制度保障提供了一条法治进路。历经十几年的发展,我国生态环境公益诉讼破除了旧有的法制藩篱,原告范围逐渐扩宽,司法救济不断强化。新时代,为进一步推进司法改革,完善生态环境公益诉讼制度,必须制定专门立法,强化检察职能,切实解决执行难问题,为建设美丽中国构筑坚固的法治屏障。

中国古典诗文体现着中华历代圣贤和文人志士的思想、智慧,蕴含着中华民族的精神品格。作为中国传统文化的精华,古诗文以其无可取代的精神力量,在提升学生语文素养的同时,发挥着独有的教化功能,实现着"立德树人"的根本任务。高职语文教学要通过对古诗文中蕴含的思政要素的深入挖掘,引导学生树立和坚持正确的民族观、国家观、文化观,实现古诗文在情感教育、道德教育和政治教育中的育人功能。     

Moral Teaching and Ethical Expression of Mrs.Warren's Profession

Mrs.Warren' Profession mainly tells how the relationship between Mrs.Warren and her daughter Vivie goes worse and even breaks up in the context of capitalism exploitation and oppression. Along with the ethical line of unaccomplished kinship, this article is to deconstruct its ethical knots of the ethical choice, ethical identity, and ethical confusion through presenting the ethical environment so as to explore its deep-hidden ethical root of unaccomplished good family relation ship.     

Determinants of Regional Political Distinctiveness

Scholarly research exploring the phenomenon of regional distinctiveness in Europe, since at least the 1960s, has generated a variety of competing theories to explain the phenomenon, including the following: the persistence of linguistic distinctiveness; the impact of economic distinctiveness; and remoteness. Often these studies operationalize “regional distinctiveness” in different ways, impeding the evaluation of different types of theories against one another. This study develops a novel measure for regional distinctiveness, applied to 161 regions in 11 European countries from 1990–2014, and demonstrates that language, economics, and remoteness work through regional parties to generate regional political distinctiveness, while only linguistic distinctiveness also has a direct effect on such distinctiveness.     

颅内出血患者血清IL-6、TNF-α变化在法医临床鉴定中的意义

目的探讨颅内出血患者血清IL-6、TNF-α的水平变化及在法医学的临床意义。方法采用酶联免疫吸附法(ELISA)对颅内出血患者住院后不同时间段血清IL-6、TNF-α水平进行检测,并与正常对照组的健康受试者进行比较分析。结果研究组重型与轻型患者后第1、3、5、7天血清IL-6、TNF-α水平较正常对照组明显增加,重型患者入院第5、7天的血清IL-6、TNF-α较轻型患者明显增加,差异有统计学意义(P0.05);根据患者最后结果(死亡组和存活组),发现死亡组随着时间延长,在第5、7天时IL-6、TNF-α水平显著高于存活组(P0.05)。此外,血清IL-6和TNF-α水平呈正性显著相关(r=0.721,P0.05)。结论检测颅内出血患者血清IL-6、TNF-α水平对观察其病情变化有重要意义,可作为法医学鉴定的辅助手段。     

Negative Life Events and Maladaptive Behaviors Among Filipino Adolescents: an Empirical Test of the General Strain Theory

Agnew’s general strain theory has been widely tested in other countries and has received general support from most studies. To date, however, there has been limited empirical test of the theory in the Philippines. Thus, this study aims to test the core theoretical propositions of the theory that link negative life events (strains) to negative emotions that in turn encourage maladaptive behaviors or criminal coping. The study uses the Global School-based Student Health Survey (2011) data on a nationally representative sample of 5920 secondary Filipino students. In general, the results support the general strain theory: negative life events (e.g., violent experiences, discrimination, sexual harassment victimization) encourage maladaptive behaviors (i.e., suicidality, substance use, and truancy), and this link is somewhat mediated or attenuated by depression. Further, conditioning factors such as parental care and supervision, social support, and engagement in physical activities moderate the effects of negative life events and depression on maladaptive behaviors. Contrary to the theory, however, some conditioning factors intensify the effects of strain on truancy. Overall, the current findings support the theory but call for further research and theory building—delinquent acts are diverse behaviors, and thus, each may require a crime-specific model of the general strain theory.

宪法诉讼的宪政价值初探

宪法诉讼制度是近代宪政理念及其制度建构发展到一定阶段的产物,并且自其产生以来就在整个宪法监督体系中发挥了不可取代的作用。宪法诉讼的价值是多元的,在宪法诉讼的价值体系中,宪政价值无疑具有最为重要的地位。宪法诉讼作为宪法的免疫器和宪政的守护神,对一国的宪政建设无疑具有首要的意义,即"无诉讼则无宪政"。     

任务型组织的动态能力建构

在社会复杂性和不确定性迅速增长的时代,考察组织相对于环境变动的动态能力显得尤其重要。在组织能力的问题上,常规组织往往着重于组织的静态能力建设,而对其动态能力则很少给予关注。与常规组织不同,任务型组织要求发展出一种动态能力。这种动态能力虽然表现为一种与环境相适应的能力,而实际上则是一种更快更好地完成任务的能力。
